    Scenario: Dog Shot in Yard

    I was asked about legal ramifications for the following scenario.

    On a 2 acre country property, a stray dog goes through the fence and attacks your cat. You cannot get the dog off and it threatens you so you shoot it. Are you in trouble?

    Additional: You don't know the dog or what it might do. You have young children and are concerned if a dog will come into your yard and kill a cat that it might come back and attack your kids.

    If a large or aggressive dog comes on to my property it will be shot if it does not run at the sound of my voice. I have small children and will be damned if they will get mauled on my watch.

    I am not sure about your state laws, but I have shot dogs and even a pissed off pig on my property before.

    The dog is on your property and it is aggressive I would shoot.

    I don't know the laws of your state, but assuming it is on your property and acting aggressively, you'd be good to shoot it.

    A couple of things quick;

    Are you in the city? Municipalities generally have rules about firearms discharge.

    If you're in the country, I'd ask around to see if any of my neighbors own the dog or know who owns the dog. If you end up shooting the dog, KILL the dog. If it gets away, wounded, and dies on their porch, you're in for some trouble (or just bad feelings).

    At worst it would be a property crime, and I think you could easily justify your actions.

    Besides a firearm, I also carry pepper spray, and a lock-blade I can open with a flick of my thumb. Since I reside in a municipality that prohibits the discharge of firearms, I would shoot a dog only as a last resort.

    However, years ago, I did shoot an attacking German Shepherd in front of the owner on public property outside of my municipality. The ISP responded to the incident, and threatened to arrest the belligerent owners. I was not arrested for anything at that time, but I was later arrested for cruelty to animals, for which I was exonerated after a lengthy court battle.

    No, after enduring numerous stressfull court appearences, I will definitely only shoot a vicious dog as a last resort.

    But they also have laws against animals agressively about to do bodily harm up to and including killing/attacking anyone, therefore I believe I would shoot, given the proper circumstances, even in a city.
    That said I live in a rural area, and I would definitely shoot an animal doing harm to any person, old or young,if I could not chase it away.
