Possibly for use, but I doubt for possession.
I use the weapon at hand to do what I have to do. Worry about the legalities later.

Humm, a few things to think about, they found a shotgun in a closet, with blood on it. Did the home owners try to hide it after the incident? I guess I wasn't clear on that. I also didn't get why the second brother went "out a window to help", and then was climbing a fence. Was he trying to get into the yard where the bad guy was, or at that point trying to flee? The article said the bad guy chased him over the fence. Also, what would make you assume the bad guy had gotten into the house? If the women knew their boyfriends had already locked the doors, wouldn't the smart thing be to stay put?
It will be interesting to see if there had been a previous exchange between this mental case and the victums, or perhaps it he went to the wrong house. It sounds like something happened before his mother arrived home, since he was all worked up before he took her car and drove to the scene.
