Rather than try him for assault I hope he is tried for attempted murder instead. After being put in a coma Foster may need many years of rehabilitation to recover, sad any way you look at it.

It's a shame but you have to be carefull to the point of not giving a damn about anybody nowadays. I was driving through OBT just south of st. rd. 50 (for those who know Orlando, Fl.) and this young guy's driving his car with the door ajar, me being the nice guy I am, pulled up next to him, honked slightly to get his attention and yelled out to him "your doors open". He gave me a mean, nasty look and yelled back "what's it to you? ". It really bothered me that I put myself in that position so I gave him the universal palms up and shrugged "whatever". It's situations like these that can easily get you into an unwanted confrontation.

is force likely to cause death or great bodily harm. This unfortunate case is an example of why blows to the head meets the deadly force defination and justifies a deadly force response.

In this case it appears the attack was so spontaneous as to allow no practical response time.
