Interesting comment from the article:This could be a fascinating case from a legal standpoint if it is determined that he was occupying the property specifically because of anticipated burglar activity. He is the homeowner and has every right to occupy the property at any time and for any reason. To say that he is wrong to be there because he anticipated a burglar and intended to kill them could be a significant test of the castle doctrine law in the state. Personally, I think that he will probably have met "letter of the law" but there will still be howls of protest from those who think he violated the spirit of the law. The burglar has a right to job safety you know.The home where the shooting took place appears abandoned and we did not see a door kicked in. So what if Mike, fed up with thieves, concealed himself inside the abandoned home and waited for the vandals to strike again. Police are investigating the possibility.

Agreed. The property owner has the right to "occcupy" and protect his investmants just as anyone else has. To think otherwise would also imply NO one has the right to defend himself in the home. This should not be confused with setting a boobie-trap for intruders.

I find it totally irresponsible of the reporter to give evidence in this investigation. He has no standing and no reason to publish such an obviously biased report.
Yeah, I know, the media has no issue with introducing innuendo into any situation if it will bring out sympathy for the perpetrator.

a) the home was not abandoned- he owned it
b) sleeping on property you own = concealed?
c) perhaps a better course would be to convince the criminals that armed breaking and entering can be hazardous to your health

Getting shot while burglarizing someone's home is simply an "occupational hazard". If one is not willing to accept what comes with the "job", how about considering honest work as a safer alternative? Just a suggestion...
Then he runs afoul of the "lying-in-wait" statutes. Even then, it depends on how it was handled. The mere fact a violent felon fails to enter without a key hardly means the violent attack on a person couldn't exist.
Though, if someone truly was unjustifiably threatening his life, it's hard to pine very deeply for such an end to such a violent person.

Definitely irresponsible reporting. Of course if you watch the TV news report, it isn't any better. Anchor starts story with "Home owner takes law into his own hands". My take on it is, you take up a life of crime, you live or die with the consequences of it.
