    As a physician I would say it is potentially a deadly weapon... Since there is no way to know for sure it should be assumed a deadly weapon by any reasonable person....

    There are thousands of pathogens or chemical/pharmaceutical compounds that could be in or on it. Some immediately deadly, some deadly over time, some incapacitating (leaving you vulnerable to subsequent harm, abuse, death), some disfiguring, some crippling... and so many other possibilities....

    The short answer YES... it is a deadly weapon when forced upon you involuntarily...

    An infected needle is more deadly than a knife! A simple scrarch can cause infection with AIDS, hep, or who knows what. If escape is impossible, then a deadly response to a deadly threat is only reasonable.
