Fl v GA Carry Differences? After viewing helpful websites...

I know that this question has been beaten to death, which is why I did research before asking it. I took a look at Handgunlaw.us as well as GeorgiaCarry.org and GeorgiaPacking.org. I am making a weekend trip up there this weekend to watch a buddy of mine get married and I was trying to figure out the main differences between carrying in GA and carrying here in FL. After viewing the websites, the only thing I can gather is that in GA I can not carry a pistol into a church, but that open carry is legal. Am I correct in this? I didn't think that these 2 states were that closely similar in laws, I also thought I read that you could protect from a forcible misdemeanor as well? Thank you for your clarification. :smile:

basically no rest stops
no govt building unless they are in a park...
no church
no political rallies
malls are ok
applebees, long horn etc are ok but you can not drink at all...

no duty to inform
you can Open carry or Concealed carry


you can not protect from a forcible Misd only forcible felonies if in fear of your life

No it has not my friend, they did not even touch that rest stop issue, that one is more important to me than any of the rest. Unfortuneatly(sp) I have to carry illegaly when I travel in Ga and stop and rest stops.

I talked to a friend today who just moved from FL to GA for a job. He told me he was escorted out of a mall by the local PD, who told him he cold have been arrested, since the mall was a "Public Gathering". Seems he printed when he bent over and someone noticed and called. You all need to keep writing those politicians.

a mall is not a public gathering.....

After thinking about a Rest Area and the Public Gathering law, I still wonder if it applies to in car carry. In Georgia, you can legally carry loaded anywhere inside your vehicle without a permit, so Permit Specific laws do not necessarily apply to in vehicle guns.

I'm wondering if the public gathering parking lot addon only applies to outside of your vehicle.

Isn't this a great thread! If we could only get all of the different laws into one book that we could carry with us as we travel about. I think a small box truck ought to be about the correct size.:aargh4:

because the public gathering law say carried while at or to...read the back of your GFL....


and i seriously doubt the fed law will help you because your not traveling your stopping at an off limits location....

Revell v. NJ Port Authority, et al.

This guy, Revell, had checked a firearm on a flight to Pennsylvania, where his carry license was legit. He was delayed, rerouted, put on a bus, cancelled, and found himself stranded overnight in the Newark, NJ airport. He got his luggage, stayed in airport hotel, and checked back in the next morning, at which point he was promptly arrested. It seems the federal firearm owners protection act only covers travel where you luggage is inaccessible. Once he retrieved his luggage in NJ, he was a criminal, whether he ever intended to be there or not. He spent 4 days in jail. The prosecutor dropped the charges, but it took him 3 years to get his gun back. The sued under section 1983 and lost. The 3rd Circuit panel says that he should have notified law enforcement at the airport and asked for his luggage to be held overnight for him. They recognize that the airport LEOs might not help, but they just hope LEOs wouldn't do that to an already unfortunate traveler (footnote 18).

This is a classic case of screwed coming and going by the government and its silly laws.

From the Public Gathering Code
(e) A person licensed or permitted to carry a firearm by this part shall be permitted to carry such firearm, subject to the limitations of this part, in all parks, historic sites, and recreational areas, including all publicly owned buildings located in such parks, historic sites, and recreational areas and in wildlife management areas, notwithstanding Code Section 12-3-10, in wildlife management areas notwithstanding Code Section 27-3-1.1 and 27-3-6, and in public transportation notwithstanding Code Sections 16-12-122 through 16-12-127; provided, however, that a person shall not carry a firearm into a place prohibited by federal law.
Some of the Rest Areas meet the definition of a park or recreational area.


All-in-all, this just goes to show how confusing and vague "Public Gathering" is to start with and why it needs to go.

BTW, military personal, reservist, etc. are exempted from most of these laws

§ 16-11-130. Exemptions from Code Sections 16-11-126 through 16-11-128

(a) Code Sections 16-11-126 through 16-11-128 shall not apply to or affect any of the following persons if such persons are employed in the offices listed below or when authorized by federal or state law, regulations, or order:

(1) Peace officers, as such term is defined in paragraph (11) of Code Section 16-1-3, and retired peace officers so long as they remain certified whether employed by the state or a political subdivision of the state or another state or a political subdivision of another state but only if such other state provides a similar privilege for the peace officers of this state;

(2) Wardens, superintendents, and keepers of correctional institutions, jails, or other institutions for the detention of persons accused or convicted of an offense;

(3) Persons in the military service of the state or of the United States
