"A disciplinary hearing for Daniel Harless, the police officer involved in a controversial traffic stop, has been rescheduled for Dec. 15. Meanwhile, Harless remains on paid medical leave even after running out of sick days. Other officers donated part of their sick time, which is permitted under the union contract, said Safety Director Thomas Ream. Ream said he approved the donations of sick time to Harless, which started less than two weeks ago. The contract clause has existed for “quite a while,” he said, noting that officers have donated time off in the past to an officer who has a serious and extended illness.
Earlier this year, the Police Department’s internal affairs division completed an investigation into Harless’ behavior during three separate traffic stops — each captured on police cruiser video. In a June 8 stop, video footage shows Harless berating a man he pulled over around 1:30 a.m. on Newton Avenue NW. Internal affairs investigators accuse Harless of violating Police Department rules and regulations for cooperation with the public, deportment and treatment of persons in custody.Harless could be suspended or fired, Ream said. Ream said a hearing set for today was rescheduled because he had a scheduling conflict.
The case stemming from the June traffic stop gained widespread attention after Ohioans for Concealed Carry posted the police cruiser video of Harless threatening William E. Bartlett during the arrest. In early November, a judge dismissed a concealed carry charge against Bartlett resulting from the traffic stop.
This is the second time Harless’ disciplinary hearing has been postponed. Late last summer, the Canton Police Patrolmen’s Association asked for an indefinite extension of the disciplinary hearing. In a previous letter to Ream, the union president had said due to post-traumatic stress disorder, Harless could not assist in his defense or participate in the hearing."

It would seem to me that the state Of Ohio would step in and bring charges against Harless. If the city PD can't clean up their own house then it's time for a greater power to do so. Protection of the citizens they serve is priority one. Fire him and arrest him and take him to trial outside of Canton. He is going to kill someone.
Being a former union rep in a police department I have a little theory on this......
I don't know the terms of their contract but in some departments the counseling form or written reprimand remains in your file for x amount of time from the date of the incident. If you can delay the disciplinary process long enough you can end up basically getting a walk. You get your annual review before the hearing so they can't use it against you, and the anniversary of the event comes up before your next review so it is out of your file by then.
And of course, if it isn't in your file it doesn't exist.
ETA: If you go on leave without pay the clock stops (as does your time for seniority purposes) so that would move your review back. If enough guys donate leave to you the clock keeps ticking as long as you are in a paid leave status.

Perhaps one of the attorneys on the forum can offer an (unofficial) opinion on the possibility of Mr. Bartlett having grounds for a civil suit against the officer and/or the department, or even a federal civil rights suit.

Just goes to show you that some are above the Law (Harless). This give them all a black eye and they wonder why some people have NO respect for them. If he's married and has kids I pray they never make him mad. There has to be some grounds for Mr. Bartlett to file a suit.

It seems ironic to me that two police officers I have known personally wound up murdered because they were essentially too affable, while this guy hasn't worked a day in months because of his contrariness, yet hasn't missed a day's pay.
Totally a "Bad Apple" who needs to be fired!!!.
Lot's and lot's of GOOD leo's out there. He is not one. There is more to this story than meets the eye. No respectable dept. would put up with this kind of behaviour. Me thinks this goes higher up than one officer.
To my way of thinking, any LEO that donated his time to this guy is basically supporting his indefensible behavior. It really proves that the problem goes beyond one bad officer.
I think he lost a job in Virginia LE for some type of offense, anyone found any info on that?
The Officer crossed the line from LEO,to raving lunatic and making terroristic threats,he threatened to kill people while in possession of a firearm,IMHO if they won't terminate him,then the FBI needs to bring charges
