Thank's to all again, but still need a little help. Most of what ur welcomed help has told me was "case law" has determined that an employee is protected by law, even without a permit, to conseal carry at his work just like owner would be. But nowhere can I see a case where this includes a bar? Does it? BTW, owner conceal carries and my boss, the manager, has cwp but beleaves it's not legal he bring his weapon inside. Is he right?
No, he is incorrect. If the bar is your place of business you are both covered under 790.25
A Bar being a prohibited place to carry only affects 790.06 which isn't applicable as an employee.
SGB, thank u so very much 4 input! My manager & I will now consider our lives r just as valuable as is the owner and I know I will be able to convince owner of the same! My manager has been armed robbed 3 times, with thankfully him not being hurt.
SGB, Is there any case law that supports this specific situation? That's all I would need to convince! Both owner & manager r great people!
Thank's to all again! U should all know I would NOT purposely put myself in this situation being employed there but I am unable to drive. I need this job and it is only 3 blocks away.
SGB, Thank u! Is there any case law that supports legality of cc as an employee in a business serving alcohol? I'm sure that's all I would need to convince owner to allow it. Thank's again!
Try this guy, I have heard much positive talk about his law firm on other forums.
Your best "free" advice would be to contact the State Attorney for your judicial circuit. If the grits ever hit the pan, they would be the ones to bring charges. Document who you speak with at that office. They are generally helpful to citizens seeking clarification of criminal code.
The Florida Dept. of Agriculture has a link to ask legal questions through their website. Contact Information - Division of Licensing, FDACS I have used it a few times and they have always quickly provided an answer. I suggest e-mailing them and keeping a copy of their official response in case you are ever questioned.
P.S. I just found this site and spent the last few days cruising the forums. My compliments for providing educational and enjoyable discussions.
