    Questions about Indiana CCW

    I am originally from Indiana. My parents and many other extended family members still live in the state.
    We are going up for Thanksgiving and this will be the first time I have been back in about 3 years. The last time was just a quick trip to visit. We stayed one day and didn't go anywhere. But, this time will be a longer visit, about 5 days and there are dinners planned at various places and other activities.

    So, just to clarify (and I will be checking with handgunlaw.us to be sure) carry in a restaurant is OK in Indiana correct? Here in TN it is not allowed if the restaurant served booze.

    Also, what is the situation on open carry? May I open carry with my TN permit? Not that I will be doing that considering the time of year. It will probably be too cold to go without a coat of some kind.

    You can carry into restaurant and your TN permit is good in the Hoosier.

    You can even carry into bars now, last I checked.

    The State is dictating less with each passing year where you cannot carry.

    Bring that TN permit up here and experience freedom like you've never experienced it before.

    I've had my Indiana CCW for nearly 30 years, I don't believe places that serve alcohol have ever been prohibited.

    I am with OD I don't know of it being illegal to carry were alcohol is sold or served. Indiana does not have a lot of places were you can not carry.

    Will also be traveling to Indianapolis, Indiana tomorrow, coming back to Texas on Saturday. Packing.org doesn't mention restaurants or alcohol as prohibited places. Schools, Casinos, airports, airplanes, State Fair, and Shipping Ports are prohibited. Bye!

    Thanks guys.
    I have checked Handgunlaw.us and I have printed out the proper pages that outline the rules for Indiana. I think I am ready.

    The worst part of this trip is the leg of the drive that passes through the Peoples Republic of Illinois. We will be stoping in Charleston MO and gassing up, eating, and locking the guns in ahard sided, locked case in the back of the minivan and then traveling at exactly the speed limit all the way up I-57 to I-70 and over to Terre Haute Indiana where we will again stop, gas up and re-arm ourselves. With any luck, our feet will never touch PRIL soil. I'll have to wash the van at some point to get the commie dust off of it but that won't be a big deal.

    We will be visiting my hometown and boy-hood home in Cloverdale Indiana. In Putnam County, about half way between Indianapolis and Terre Haute. A very pretty little town and a nice place.

    I will probably be off line for the next few days, until Sunday so if I do not get a chance to pop in here for the next few days, I want to wish everyone a Happy and Blessed Thanksgiving. Eat all the turkey you can and watch a bunch of football. That's what I'm doing.

    See you in a few days everyone. We'll be careful on the drive.

    pt-111 welcome to Indiana and have a great trip. Indiana is a greta state as far as carry goes. Thats a nice part of the state your visiting I used to deliver in that neck of the woods. As Im a local truck driver. Im origanaly from Cleveland Ohio but live near the Warsaw area now thats another nice place to visit. With the village at winona. and a great mountain bike trail there to for the bikers. Have a great trip and be safe.

    PT-111 I had to laugh when i read what you said about Illinois. I just came from there with a gut full of turkey. I live right across the river in Kentucky. I have a brother and sister that live in Illinois. My bro n law were shooting guns there today. I go there often. It just makes me madder than hell to have to lock my gun in a box before i cross that 1 mile bridge.....

    Dang sixgun your not far from me at all. New Paris just north of Milford and south of Goshen. Maybe one day have to meet up for some coffee as long as it has enough room for a Big Truck,lol

    Just got back in lastnight and we all want to move up there. Every tome we go for a visit we leave more determined to move there than the last time.

    What a beautiful state. Even now, with all the leaves gone off the trees and the fields all bare, the state is just beautiful.

    I love that state and I am 100% determined to move my family there as soon as possible.

    residence

    so what do i do if my parents address is my permanent address on my CCW but they move to another state? i'll be staying in indiana for college and probably the rest of my life so how do i get around this?

    If you are going to be staying in that house it is ok, remember no concealed stipulation here. However if you are going to be moving out and to a new place you have 30 days to notify the state police in writing of your new address. If they are moving and you are not, its not an issue. If they are moving and you are moving into an apartment or dorm, list the dorm address or apartment address in your letter. Police don't really check this, just make sure it matches your DL. More specific questions feel free to PM me and I will answer them for you. If I do not know the answer, I'll look it up in my code book and get back to you

    mgt most of your answer has been covered already. If you will be in an apartment then you will be a resident change the address have it match that on your drivers license and your set, proving residency wont be that hard.

    If your parents address will be your address, then just attending an institution of higher education in Indiana; does not constitute Indiana Residency as far as your drivers license is concerned. However if you have no other legal residence and have other means simple as paying a power bill, having a medical bill, pay stubs etc. then you could prove IN residency, and make the fact you are a student irrelevant. The same would apply to a person who is serving on active duty in the Armed Forces, which the BMV does says does not constitute IN residency. Which leaves us with this semi applicable reference from the State Police Firearms FAQ sheet.


    I am in the Military and my home of record is in Indiana, can I somehow get a permit
    issued while deployed/stationed out of state?

    Even if your home of record participates in the electronic application process, the application
    must be received and processed by the local law enforcement agency covering your home of
    record
    , which includes a personal visit at that agency unless other arrangement have been made;
    therefore the state police must refer you to the local agency to see if they can accommodate your
    situation. In most instances, you will have to wait until you are on leave to apply.
    This applies in the reverse of your situation but points out that if you do not already have your IN license before they move and you do not obtain IN residency on your own you will not be able to apply for a new IN LTCH.

    So much of this depends on exactly what your residency status is and what your permit status is. You may need to consider getting a new DL for you, and then you'll need to obtain the appropriate out of state permits for carry to be legal in IN and those permits would need the address matching your DL.

    Now the BMV site while helpful certainly does not constitute law, even if presumably reflects it, so I'm also going to provide some statues that you may find helpful.
    IC 3-5-5-3
    Residence in more than one precinct
    Sec. 3. A person does not have residence in more than one (1) precinct.
    As added by P.L.12-1995, SEC.10.

    IC 3-5-5-4
    Abandonment of residence
    Sec. 4. A person who has a residence in a precinct retains residency in that precinct until the person abandons the residence by:
    (1) having the intent to abandon the residence;
    (2) having the intent to establish a new residence; and
    (3) acting as provided in this intent by establishing a residence in a new precinct.
    As added by P.L.12-1995, SEC.10.

    IC 3-5-5-7
    Temporary residency
    Sec. 7. A person does not gain residency in a precinct into which the person moves for:
    (1) temporary employment;
    (2) educational purposes; or
    (3) other purposes;
    without the intent of making a permanent home in the precinct.
    As added by P.L.12-1995, SEC.10. Amended by P.L.3-1997, SEC.18; P.L.164-2006, SEC.5.

    IC 3-5-5-9
    Person moving with intent to remain for indefinite time
    Sec. 9. If a person moves to another state with the intention of remaining in the other state for an indefinite time as a place of residence, the person loses residency in Indiana, even if the person intends to return at some time.
    As added by P.L.12-1995, SEC.10.

    IC 3-5-5-11
    Location of immediate family as residence
    Sec. 11. The place where a person's immediate family resides is the person's residence, unless the family's residence is:
    (1) a temporary location for the person's immediate family; or
    (2) for transient purposes.
    As added by P.L.12-1995, SEC.10.

    IC 3-5-5-12
    Living away from family while conducting business
    Sec. 12. Except as provided in section 13 of this chapter, if:
    (1) a person's immediate family resides in one (1) place; and
    (2) the person does business in another place;
    the residence of the immediate family is the person's residence.
    As added by P.L.12-1995, SEC.10.

    IC 3-5-5-13
    Living away from family with intent to remain away
    Sec. 13. If a person:
    (1) is living at a place other than the residence of the person's immediate family; and
    (2) has the intention of remaining at that place;
    the place where the person lives is the person's residence.
    As added by P.L.12-1995, SEC.10
    As you currently stand, your residence is that of your immediate family and you are away for educational purposes. Educational purposes seems to operate on the presumption of return to immediate family for some period of time after school completes. Your from moving from your immediate family with intent to stay away needs to be demonstrated beyond just going to school in IN while they leave.
