    silly question about texas CHL

    I had an opportunity to take a poll of sorts at work today.
    I'm hospice nurse and everyone was in for meetings,so I asked if any of them carried a handgun, or mace,or anything for personal defense.
    As you may guess we go everywhere at all hours. I was surprised that only 1 in 15 (all women) carry a gun (in her glove box). I'm the boss, so I told them they didn't have to answer. (I have sometimes been politically incorrect)

    Led to lively discussion. One lady said if you get the chl in Texas that it is attached to your driving licence and if you were to be pulled over and breath tested and found to have ANY level of alcohol you would lose your driving license even if you weren't actually carrying.

    This doesn't sound right. Is she right?

    Texas Penal Code 49.01(2) says:
    "(2) "Intoxicated" means:

    (A) not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or

    (B) having an alcohol concentration of 0.08 or more."

    ...and 46.035 uses that definition because we carry concealed under GC411.SubchH...and 411.171 (6) says we do...

    ...now you can be SURE what the law says...

    ...we've got as many "experts" in TX as we do armadillos...maybe more...if they can't show you in the black letter law...don't count on it being true...no matter how many stories they can tell you...

    Good. I'd hate to have to give up my right to drink responsibly in order to carry a gun responsibly. That would be a deal breaker.

    AMEN, I heard that! I'd never in my life give up my rights to carry a gun just to have an adult beverage ~ reckon it's all about priorities. Give me my semi 12G, box of shells and a hand dipped ice cream milk shake and you are looking at one happy, happy, happy lady!

    I'm glad you got your answer. What your co-worker told you just didn't sound right.

    Maybe you can arrange with a CC instructor to get the ladies in a class at a reduced fee. Voluntary of course.

    My daughter is a hospice nurse, and she did go everywhere at all hours sometimes, and in BAD neighborhoods. Thankfully she never had a bad experience. She did mention that it was her perception that even in bad neighborhoods, most people recognized that she was there to help someone, so she never got harrassed, of course that's no guarantee that she wouldn't some day.

    She also had legal drugs with her sometimes, mostly morphine. She did carry a weapon with her. Currently she is the QA nurse for her hospice group, now that she stays at the office, we were very relieved, but the other nurses aren't so happy (QA!)

    Turn the election's in 2014 to a "2A Revolution". It will serve as a 1994 refresher not to "infringe" on our Second Amendment. We know who they are now.........SEND 'EM HOME. Our success in this will be proportional to how hard we work to make it happen.
