I took it off and left in the the truck.
I went through a MD, but I didn't have to remove my belt.
I asked the Marshalls about wearing an empty holster and they said NO. They said it would draw to much attention if seen. They said a Judge would freak out if they saw it, even empty, then said judge would come down on the Marshalls for allowing it.

When I picked up my marriage license I left my holster on. The sheriff deputys didn't seem to mind it nor did they make me remove my belt. They did wand me due to my steel toe boots setting off the metal detector. Then again this was a local court house not federal.

I would challenge the Marshall to quote the law forbidding an empty holster.

There you go, that's starting a LEO contact off on the right foot.

When flying I leave my empty holster and mag pouch on. TSA has seen it and I always get funny looks, but it has never caused problems.
Once my luggage comes off the conveyor belt I unpack my weapon and re-holster in the latrine.

It depends upon where you are. I don't get hassled in my city -- that is until they found my cell phone in my holster (which is a no-no), but they graciously agreed to store the phone until I return.
P.S. It helps if you are a lawyer on your way to court.

I don't think the Marshall's said it was illegal. They said "NO," “it would draw to much attention if seen,” and “a Judge would freak out if they saw it, even empty, then said judge would come down on the Marshall's for allowing it.”

Your right. They never sais it was illegal, they just said they wouldn't allow me to wear it inside the building.

You will have to remove your belt for inspection anyway so leave the goods in your truck.

I'm sorry but things like this just seem dumb to me. If you have to take your gun and magazine off and leave it in the truck, just take it all off and avoid any hasle. Any empty holster does you no good and will only cause you grief in a court house. The hasle is definitly not worth the 30 seconds you saved by not taking it off.

I'd really be curious to know if you would be willing to follow your own advice?
When you’re wounded and left on Afghanistan’s plains,
And the women come out to cut up what remains,
Just roll to your rifle and blow out your brains,
And go to your God like a soldier.

And he would probably write it down on a few forms on your behalf, at least I would anyway.

Sure I'd ask him. I can't find it. Where do I look Sixto?

I have to agree, and remember, a "rule" does not have to be a law, to be enforceable.
Our court houses do not allow shorts or tank tops. This is not a law, but it is still enforced.
And why would you want to give the Marshal a hard time to begin with? He is doing his job. More than likely, he is on your side, as far as 2nd amendment rights... that is, until you show up trying to make some kind of statement with an empty holster.
