    Handguns In casinos

    Kind of a no brainer. I copied this from an article from another BLOG. ;Restrictions



    Even with a permit to conceal and carry a firearm in the state of Florida, there are certain places where it is never legal to carry the gun. These places include any "place of nuisance (casino or gambling hall, for instance), any police or sheriff's station, any jail or courthouse, any courtroom, any polling place, any place that serves alcohol as its main function (bars, night clubs), and any school or athletic event. There are also restrictions on carrying a firearm into an airport, so it is always best to check ahead for the proper procedure to check firearms as baggage.

    Time to consult an authority.

    ... Thus, it is not "technically" illegal to have a firearm in a casino with a CWP - although it is highly likely that such is not permitted by the casino and thus could result in a trespass warning, and maybe even an arrest.

    Personally, I would not risk it...

    A place of nuisance as it relates to gambling is illegal gambling. The place of nuisnace is a catch all for any place there is lawbreaking and you are there and party to it, essentially.

    ETA: Since I live here and occasionally visit the grounds I decided to call them since I had in the past reviewed the tribal web page and found it to be silent on the topic.

    1. Called the casino and the security rep said nope, can't do it it's posted at every door. I advised I had been there and never seen a posting but moreover I wanted actual documentation to refer to for my students (and my self). He gave me the number to the tribal police....this gets more interesting now.state
    2. called the tribal police at 954-967-8900 James and spoke with "James" who restated it wsa not allowed. When I asked about the actual statute he referred to FS 790 which he said prohibited guns from tribal areas but could not make a citation. He said he would have a superior call me.
    3. Pulled up FS 790 (entire text) and the term tribal nor seminole exist in the entirety of the text of FS 790 which is Florida's Weapons and Firearms statutes.

    I look forward to hearing back from them since it appears they are relying on the state and the state has no jurisdiction as far as I know. I'll update when (if) they call back.

    ETA: wow they called back pretty quickly. First they stated that unlike the Micosukkee (sp) tribe they do not have their own law but instead follow state law. After further duscussion he stated that if you are in the casino but not the bar and it is noted you would be walked out. If you are in a bar it is the officers discression whether to arrest you or walk you out (tresspass).

    I'd like to see the AGs read on this since there was some ambiguity about just being on the campus. IANAL but if they are following state law it is permissible until they tell you to leave and you stay out of the bar areas.

    The text above is not directly from the statutes.


    823.05 Places declared a nuisance; may be abated and enjoined.--Whoever shall erect, establish, continue, or maintain, own or lease any building, booth, tent or place which tends to annoy the community or injure the health of the community, or become manifestly injurious to the morals or manners of the people as described in s. 823.01, or shall be frequented by the class of persons mentioned in 1s. 856.02, or any house or place of prostitution, assignation, lewdness or place or building where games of chance are engaged in violation of law or any place where any law of the state is violated, shall be deemed guilty of maintaining a nuisance, and the building, erection, place, tent or booth and the furniture, fixtures and contents are declared a nuisance. All such places or persons shall be abated or enjoined as provided in ss. 60.05 and 60.06.

    As such the Place of Nuisance statute does not apply or the joint would be illegal to start with IMHO.

    So we're about to go the the casino today and I googled this and came up with the perfect question I was about to post.

    So instead of re-posting, I will bring this back...

    This is interesting. I don't usually go anywhere un-armed but I might have to make an exception today... I don't like to that at all, but perhaps it's not a bad idea.. I also thought of bringing a pocket pistol instead of a full size 1911

    perhaps this is where you gotta decide the carried by 6 or judged by 12.

    tough decision...

    And if you are caught, not only will they throw you out, you may well find yourself banned for life from every casino in the country. These folks do maintain lists of "undesirables". :)

    You pays your money & takes your chances. I've read more than once about a big winner from the Hard Rock in Hollywood (FL) being followed home & robbed by BGs. That will probably never happen to 99.9 % of the patrons (being big winners.)
    Still, it's probably like the mouse kingdom I think. Don't tell and if detected carrying you'll be asked to leave.
