    Carry question

    Got a question I am down in TX to propose to my girlfriend and have a CWP from SC and we are going to a resturant reccomended by a fellow DC member and they serve wine can I carry in the resturant or do I need to disarm.

    As long as they do not derive 51% or more from alcohol sales you can carry in the restaurant,they should have a big red "51" if they do and their liquor license will be red instead of blue,but I would say a restaurant usually is good to carry in

    You can double check here, Texas3006.com - Your 30.06 Information Resource - Home, but this is just a collection someone has put together so you will need to verify with a 51% sign or a proper 30.06 sign.

    You can carry as long as their is no big red 51% sign. But also, in Texas any ETOH on your breath is too much if you are armed. If you plan to drink don't carry. Good luck!

    It is only illegal to be intoxicated, and carrying in Texas. Simply consuming alcohol and carrying is not illegal. It may not be wise, but not illegal. Intoxication B.A.C. is 0.08, in Texas.

    Just make sure when you get down on one need that you don't expose your carry gun!!!

    Here are a couple definitions from the statutes provided by the state.
    "Intoxicated means substantial impairment of mental or physical capacity resulting from introduction of any substance into the body."

    "(2) "Intoxicated" means:
    (A) not having the normal use of mental or
    physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or
    (B) having an alcohol concentration of 0.08or more"

    Notice the OR

    Here is a question and answer from the back of the booklet provided by the state during the license class.
    Q: Can I carry a handgun if I am drinking alcohol?
    A: No; it is illegal to carry a handgun if you are intoxicated.
    But if you are authorized to carry a weapon, and you walk outside without it, just take a deep breath, and say this to yourself...

    I remember my instructor said that you can't drink any alcohol and carry, I tried to find something on this but could not, if someone can clearify this issue ,I will be gratful.
