    Unhappy Ccw denied!!! (Merged)

    Scenario, 42 yo with an ungraded misdemeanor marijuana possession in 1991. 1st and last law infraction. Was denied my ccw, after reviewing the requirements to apply, I felt I met them. Anyway any suggestions. Lawyer for appeal or just apply to a state that has non-resident permits. Thanks for any help.

    WOW. They must not have a time clause. Ours is 3 years I think.

    Contacting an attorney that handles those sorts of cases would be the correct way to go on that.

    +1. I think you might have the same problems with other state's background checks. Try and get the record cleared.

    Thanks for the responses, I guess Im still not clear on NC's requirements. Like most states they ask if you have felonies, I know VA asks if you have any 3-5 years preceeding your application. Man I hope a lawyer can help.

    Agreed.

    Also as you now have been denied it is cumpulsory to state as much on most every other states application and to explain the reason why, so now your chances in other states are reduced too.

    Get a lawyer.

    This is what appears to be the reason for denial of your permit. Statute does not specify a time limit on when the conviction took place. You might want to check and see if the conviction can be expunged from your record. Other than that it looks like you may not be able to get one in NC. As to getting a non-resident license from another state that is honored in NC, I think you are treading on shaky ground trying to make an end run to bypass NC law as a resident.

    The sheriff must deny the permit if certain prohibitions exist. The application must
    be denied if the applicant:
    4. is an unlawful user of or addicted to marijuana, alcohol, or any depressant,
    stimulant or narcotic drug, or any other controlled substance;

    archer51 true, but is a misdemeanor possession charge 17 years ago make a person a addict???

    How is making an end run to another state that asks if you've been convivted 3years preceeding your application being wrong?????

    I think he was suggesting that other states often ask if you've been revoked or denied elsewhere.

    Also, while I am not familiar with your laws, in my State a resident cannot carry using an out-of-state permit, they must have a resident permit. This may pose another issue for you - I would check on it.

    It's possible that if you have been denied in your state and get a non resident from another state,if you are stopped and they check your record and find a denial for a resident ccw you may be arrested for illegal posession of a concealed weapon,then you be looking at I believe a felony with no chance of ever carrying again
