    Michigan Legal Questions

    I have a few questions that I have not been able to find the answers to:

    1. I have been searching the Michigan Legislature site but I cannot find the answer to this question: What is the law in MI regarding the "No firearms allowed" signs? I have never seen one but what is the legal ramification if I ever do?

    2. My employer has a no weapons policy. However, I work away from any of my employer's properties. My job entails me visiting customer sites and when I have reports to write or administrative work to do I work from home. I only go into the office once per quarter for meetings.

    My question is this: if the client site I am visiting does not have a sign posted prohibiting guns, would I be allowed to carry concealed while doing my job at client site?

    3. Finally, didn't MI change the law so that CPL holders can carry concealed in any establishment that sells alcohol but where the sale of alcohol is not the primary business? For example, I could carry in TGIFridays but not the neighborhood bar or nightclub.

    I would be interested in this too, since it looks like I'm moving up there at the end of the year.

    #3 YES --others ?? could offer an opinion but that is not what you asked for. Others will do that.

    1. It will be a sign with "No firearms allowed" with a gun and a circle and a line through it. Like pic below..

    2. I don't see why not long as you are not using their auto and use your own car.

    3.Yes. If 51% of the sales are other than alcohol

    I know Unfortunately, my wife ended up picking up a job there and I'm trying to follow by getting a transfer from my current job (government) to one that is open up there.

    Questions 1 & 3 have been answered. As far as question #2, it would depend on how exactly the company policy is written. If it says "No weapons on company property" then technically you would be alright. If the policy says something to the effect "No weapons allowed at work" then you would be in violation of company policy, since you are working, even if at a remote location. At your own home, I don't think anything would be said, however at a clients location, it would probably be considered a violation. In either case, be prepared to lose your job if your caught with a weapon while on the clock.

    1. You can be prosecuted for carrying CC where the "law" forbids it & will probably lose your CCW if caught.
    Heres what MI law states for carrying concealed:

    "Individuals licensed to carry a concealed pistol by Michigan or another state are prohibited from carrying a concealed pistol on the following premises: Schools or school property, public or private day care center, public or private child caring agency, or public or private child placing agency, sports arena or stadium, a tavern where the primary source of income is the sale of alcoholic liquor by the glass consumed on the premises, any property or facility owned or operated by a church, synagogue, mosque, temple, or other place of worship, unless the presiding official allows concealed weapons, an entertainment facility that the individual knows or should know has a seating capacity of 2,500 or more, a hospital, a dormitory or classroom of a community college, college, or university, and casinos. "Premises" does not include the parking areas of the places listed above, excluding casino parking. A pistol is subject to immediate seizure if the CPL permit holder is carrying a pistol in a "pistol free" area.[124]"


    2. Unfortunately my employer bans them as well As long as you dont work in a states so called "gun free" zone, if you do carry & get caught the only thing that can happen is you will probably lose your job, but as long as your not in violation of state law your job is the only thing in trouble.


    3. Yes the primary source of income can NOT be alcohol, so places like "Applebees" are legal to carry but of course NO you can not carry in "bars" or "nightclubs"

    You could be charged with trespassing but you would not have a firearm violation.

    Michigan is an at will employment state. You can be fired for any or no reason. Michigan also does not have any laws telling private companies what to do about firearms.

    Thank you all for the input. I'm not sure of the exact wording in the handbook with regard to weapons. Maybe "on company premises" would be different from "at work" . I will have to do more investigation. This point is important to me. Last year a co-worker had just completed a site visit at a company a week prior to a mentally imbalanced employee shooting several and killing one.

    DM2, Like Leader wrote - the bigger deal is that Michigan, like most states, is an at will employer. Your boss can fire you if you happen to mention guns in a customer's presence or if you chew the wrong gum.

    I'm in a similar boat but it's even worse because I'm in and out of hospitals all day long (No CCW in hospitals in MI). If you choose to cary at work, deep deep conceal and never ever let anyone find out.
