Non-Resident Permit (Nevada/Las Vegas)

Hello everyone. I have a question about the non-resident CCW permit in Las Vegas I am hoping someone here can shed some light on.

I will have to give a little info in order for you to answer me so let me start out by saying I am a 28 year old man, currently living in NY. In a few months I will be traveling to Nevada to stay with my father who is a disabled USMC Vietnam Vet. He lives in Las Vegas.

I do not currently own a handgun but I have been shooting all my life. I never bothered to apply for a CCW permit here in NY simply because I didn't feel like I should have to prove myself to a judge in order to receive it. I understand in Nevada it is a more simplified process involving applying with the sherrifs department.

Obviously while staying in Las Vegas I will not be changing my residency to Nevada from NY, as I am just visiting for several months, so I would like to try to receive a non-resident carry permit. However, where I feel like I will run into a problem is this - how do I get a gun? I understand I cannot purchase a pistol in a state that I do not live in? Well I also can't purchase one in NY (the state where I do live.) because I don't have a permit or anything. So where does my gun come from?

Your "handgun" must be purchased in the state you are a resident in. This is Federal law. You can buy a rifle or shotgun in Vegas if you want. Buy your gun before you leave your resident state, then take the CCW classs in Vegas. You will need to have a gun to take the class anyway, you must qualify with the gun you expect to carry.

As Rcher said, you must qualify with any gun that you want to carry concealed, so you'll need to have it when you come to Nevada. The process it self is simple- you need to take the class, and I believe that will need to be a Nevada class, not sure. You than need to qualify, as each gun that you will be allowed to carry is listed on the back of your permit. Then, you go down to the sheriff's department, where you turn in the app, then get fingerprints, and a picture taken. You'll then need to wait for it to be mailed to you. I was lucky, as when I got mine, it only took 90 days. Now, Clark County at least takes a lot longer. As a nonresident, you don't HAVE to apply to the Clark County sheriff (Las Vegas area), you can apply to any sheriff's dept. But if you're in Vegas, Metro is much easier to get to. If you're able to swing it, you may want to consider a trip to Vegas just to take the class and apply. Otherwise, you may not even get the permit while you are here. Sorry, but that's how it goes here in Sin City.

Most states of laws of residency where you must register your vehicles and drivers license to that state. That said, you may want to go ahead and make NV your home state, make things much simpler for you.

You can get a Nevada Id card and still keep your NY lic. I have one. You will be going back and forth correct? Wink Wink

As I recall, the only individuals who can legally buy firearms are people with a valid Nevada DL or ID. You really should get a Nevada ID while your here in Vegas. In some cases, having only an out-of-state ID could make it difficult in firearms legal issues.

as a former ny resident, why not become a nv resident? everything here is simplier unless you'll still be employed in ny.

inorder to purchase a firearm in clark county, you'll need DL not with ID card.

I didn't know that you couldn't buy a firearm if you were an out of state resident & had a NV state ID card! Seems unfair all the same to me.

Ask your father to purchase a gun that you would be comfortable with, and he could loan it to you while you are out there.
(Unless there's some Nevada law that says you have to own the gun you qualify with and carry. I doubt it, but you can check).

You can absolutely purchase a handgun outside of the state of your residence. You just can't do it personally. The transaction has to take place through a licensed Federal Firearm Dealer (FFL) in your state of residence. The catch is that the gun you buy still has to be legal in the state and/or municipality of your residence.

You simply buy the gun, in person, online, whatever, and the seller ships the gun to your FFL (who charges a fee for the transaction and for a background check). You'll have to abide Brady Law requirements, but you'll be able to pick up your firearm after proving residence.

This is not true. What if I have a home in two states? I live in each state for 6 months...I cannot be a resident in both states, and I cannot vote in two states.
One can be in any state for considerable time without becoming a resident of that state...it's not just time in state. There are other variables. OMOYMV

To the OP...
You're in a tough spot. Using hindsight, I would have gotten a permit from your home state (knowing it's a stupid process), a lot less hassle than what you'll go through in NV. I would still begin the process in your home state, and get your firearm where you're going to be living anyway...why not?

May I respectfully offer a few corrections to your post?

You only need to qualify with each semi auto you want to carry and you don't have to own it and bring it with you. You can rent or borrow one. If you qualify with ANY revolver, you will have "revolvers authorized" on your permit and you can carry any revolver you choose.

Permit issuance is currently running about 30 days in Las Vegas.

Nevada is a "Free Carry" state and Open Carry is de facto legal because there is no statute that forbids it. I would HIGHLY recommend that you don't OC on The Strip or at the Fremont Street Experience downtown.
In Las Vegas, it's ALL about the tourists and their gambling money. The casinos don't want their clients distracted over anything.

This is only partially true and pertains to people who become employed in Nevada. He doesn't have to become a resident to help his dad as a caregiver.

Can you please cite a Nevada Revised Statute to support your first sentence?

This is a very good solution. You don't have to own the gun and it doesn't have to be registered to you, but it must be registered and although you don't have to carry the blue registration card, in your case, I would advise you to do so.

When you return to New York, you can have the gun 'gifted' and shipped to your FFL at home.

Golfaholic be correct about the online out of state purchase.

Although you can purchase a gun from someone out of state, you CANNOT take physical possession without going through a local FFL.

I don't live in New York and so I'm no expert on buying and possessing handguns.

Are you required to get a permit to purchase, import, or own a handgun in areas other than NYC? I know how restrictive they are, but I thought it was a LOT easier if you lived upstate, etc.
