    Question about VA CCW permit

    As cliche as this is, I have a friend that was arrested for brandishing
    about 5 years ago. My understanding of the events are someone
    called the police saying he had a gun. The police came out found him
    in his home still in uniform (armed security) from work. The police
    saw, this laughed it off and left. A full month later, a detective going
    over the case thought there was enough to convict him, the police
    came out and arrested him on a warrent for brandishing. Went to
    trial and the judge dismissed the charges.

    Now to the question, His work needs him to get a concealed permit
    for the site he is being transfered to. Would that arrest keep him
    from gaining a concealed permit? The his lawyer had the arrest expunged from his record.

    I would say no, it won't harm his getting a permit. If it does he and his attorney can file an appeal with the Chief Justice of the Virginia Supreme Court. Believe it or not but you can still be arrested in Virginia for spiting on the sidewalk. Most if not all the judges would laugh it out the door.

    No. He was only arrested, not convicted of the charge. The charges were dismissed and if the arrest was expunged from his record as tyou say, it shouldn't even show up on his background check.

    Yep, no conviction no problem. Even if it wasn't expunged it was 5yrs ago and a misdemeanor so no problem.

    I'd put it down on the application anyways (it asks for incidents involving an arrest) but it shouldn't affect anything.

    He should be fine but I sure hope he filed a complaint against that detective!!!
