Private sale to someone younger than 21
I ran an advertisement in our local paper today for my G34 Glock and had a caller who wanted to see the gun. We met and I showed him the gun, extra magazines, carrying case and 170 rounds of practice ammo. During the course of the discussion I asked him how old he was and he said not quite 21. He is from the state where I live, so that part passes muster, but I can find NO information on the ATF site or our state's government site on the legality of selling a handgun face to face to someone of this age.
Any advice and references to legal sources would be appreciated.

In N C no one under 21 can purchase a handgun, they can posses a handgun after they turn 21 but cannot buy one till they turn 21, makes no sense to me . they can join the Militery, fight and die for our country and cant buy a handgun till 21, go figure.

It is dependent on state law. A FFL may not sell a handgun (or handgun ammo) to someone under 21, but if state law allows it can be done in private sale.
IIRC a couple states even allow you to get a CCW at 18...
I know in VA it is legal for someone to OC a handgun at 18.

I'm pretty sure that federal law says that you have to be 21 to buy a handgun. Wish I had a better citation.

Sorry bo, you are incorrect.
Here in NC you can carry/ posses a handgun at 18. AND, if its a private party sale you CAN obtain a purchase permit wthout being 21. The only problem is finding a sheriffs department that actually KNOW the law.
I've carried since I was 17, been stopped 3-4 times, twice that many checkpoints/traffic checks, no problems yet.

Only if purchased from an FFL.....private sales = IAW state law.

Be safe..wait till he is 21..I think in texas you cant buy a hand gun till you are 21..But you can be a commissioned security officer and open carry one if you are in the proper uniform when you are 18..Can carry..Cant own...

I would call your state's Department of Public Safety or whatever department handles Firearms questions. Ask them to be absolutely sure.

In Texas you can be a peace officer once you're 18. You can't buy your own ammo or your own handgun, but you can be a cop... Private sale to an 18 yr. old is okay in Texas...

"62.1-03-02. Selling handgun to minors prohibited - Penalty. Any person who sells,
barters, hires, lends, or gives any handgun to any minor is guilty of a class A misdemeanor. This
section does not prohibit a person from lending or giving a handgun to a minor if the minor will be
using the handgun under the direct supervision of an adult and for the purpose of firearm safety
training, target shooting, or hunting."

But what does minor mean? Younger than 18 or younger than 21?
Here in WA it's perfectly legal to sell a handgun to an 18-20 year old in a private sale..
