Angry Rant: Had to Return Brand New Magazine Because of Capacity!

I recently bought a new CZ RAMI 9mm, which came with two magazines. I've been using the first one that came out of the box. But when I cleaned the gun/magazine the other day, I thought I would swap and start using the other magazine that came with the gun.

To my surprise, it was a 14 round magazine! In New York, this is (still) illegal and it's a Class D felony to own, transport, or otherwise have in your possesion.

I went back to Gander Mountain, where I purchased it, and they acknowledged the mistake, saying it slipped through the cracks. It should have never been included with the gun.

So now I have to wait a few weeks for them to order a 10-round mag for the gun.

Anyway, that's my rant for the day, on yet another stupid NY State law.

This started because we let the libs create a phrase that changed public perception. One day, a 'normal capacity' magazine was given a name - 'High Capacity'. We laugh about stuff like this but when they started calling 'normal capacity' magazines 'high capacity', it caused a shift in thinking that made it easier for the moonbats to lead the sheep. The same goes with 'assault rifle' and 'sniper rifle'. Today, they throw those monikers onto your rifle and tomorrow it will be easier for them to be confiscated, then one day you'll have to turn them in just like this poor schumck had to turn in something as harmless as a normal capacity magazine.

You should leave that communist dystopia and help us someplace where liberty still has a few glimmers of light yet remaining.

Yes, I know. But, as everyone on this forum knows, it's good that I at least know the NY State Law! It would have been really bad day if I got caught with it.

(I even sort of kept it concealed as I went back into Gander Mountain, lest I be found out)

No, of course not. But, heaven forbid, if I needed to use it, and I got caught with it, the DA would have a field day, with an illegal magazine used in a shooting.

It isn't easy walking that line of being a law abiding citizen, is it?

I would think a stupid performance would help out there.... You have the reciept and it shows the personal defense tool came with two mags,.. ??? Seems logical to me,.. But then again.. Look at who-what we're dealing with,. logic was throw out,..well - - - lets see - - - how long ago???

I'm sure you did the right thing, now you'll be able to sleep better knowing there will not be an issue.. Hopefully that stupid law get's throw out for you,....

Yes, but the receipt does not show the capacity of the mags. As you know, ignorance is no defense, and just because Gander Mountain made the mistake, that would not stand up in a court. The judge would just say "didn't you notice it when you used it". It's a clear violation.

    BTW, here's the actual law:

A person is guilty of criminal possession of a weapon in the third degree (Class D Felony) when:
    .
    .
Such person possesses a large capacity ammunition feeding device.
    .
    .
"Large capacity ammunition feeding device" means a magazine, belt, drum, feed strip, or similar device, manufactured after September thirteenth, nineteen hundred ninety-four, that has a capacity of, or that can be readily restored or converted to accept, more than ten rounds of ammunition"

You did the right thing, no matter how wrong it feels.

Someone else said to move to a free state...good idea although difficult to do. What may help even more is if you could help change the color of that cesspool state you are living in, cue Mission Impossible music, would be nice to have those electoral votes in 3 years. Not saying you are not trying but that would be nice.

Thats too bad. If this is going to be a CCW or a HD gun you should probably buy some additional 10 round mags...

Actually, it's not in the realm of possibility. I have an elderly mom (92) next door to me, and, believe it or not, I love the Hudson Valley/Catskill Region.

Hey the same thing happens here in Canada. All you have to do is pin it to a ten round mag. Most of my mags are rivited on the side so the follower can not go lower then the rivet only allowing 5 rounds all like my AR mags. 30 round mag pined to 5, what a waste. Pistol mags are 10 round mags also. If you were to go to VT remove the rivet and you have a 14 round mag. You leave VT put the rivet back in. Now you are good to go back in NY. Just a thought.

Not a bad idea, but alas, it's already returned.
