    No, The SAW Ban of 1968 expired 9/13/2004. For the 10 years that SAW ban was in effect, Import and possession of "Assault Rifles" was banned. The expiration allows AR-15 and other rifles previously on the banned list to now be imported and possessed but does not change any weapons defined by the National Firearms Act (NFA).
    Machine guns are on the NFA list as needing to be registered. Specifically "Any combination of parts designed and intended for use in converting a weapon into a machine-gun."

    There is much more to it than this. Generally it is not legal for a non licensee to make a machine gun. The exception is to provide documentation to ATF which establishes that the weapon is being made for the distribution to a Federal or State Agency. There is still a $220 tax, etc. Making a machine-gun and acquiring a machine-gun are not the same. If the machine-gun or machine gun part is not registered it can not be registered by a private citizen.

    What is not illegal is legal. Here are some of the things you need to obtain an 02-FFL. This does not mean that your place of business can not be part of you house as long as there are no local zoning rules the prohibit it.

    1. You have to have a place of business with posted hours. You can't sell by appointment only or just a gun shows.
    2. You will need a business license unless none is required, some rural areas, etc.
    3. You have obtain a law enforcement official such as a local chief law enforcement officer or a county sheriff off sign off.
    4. Fill out the required ATF forms.
    5. Send in Wet finger print cards.
    5. Wait 45-90 days or more, ATF contacts you for an interview and to inspect your place of business after they have completed background checks including speaking with local authorities.
    6. If approved, you sign an date your FFL.
    7. At some point, I don't remember if it is before or after the interview, you send in an annual license fee of $1,000 for a class 3 license.
