    Why doesn't the guy just drive away - didn't see the other gue with a gun also unless I missed it. Shut the windows and haul, would be my impulse form the start.

    His window was down. In Louisiana, if your DRIVER'S window is down, Castle Doctrine goes out the window (no pun intended).

    I guess my info could be a little flawed, but I'm just relaying what I was told, by a lawyer, no less. I mean... I agree with you... the AC in my car doesn't work. If some pissed off guy comes running to me on a hot summer afternoon, I'm not gonna want to raise my window. I may not even have time. I don't like it and a I hope I'm wrong.

    I didn't ask her about the ATM scenario. Didn't think of it.

    I love the way he points the gun at his own leg as he tries to get it functioning. Isn't there a large artery located somewhere in that area.

    Details of some State's laws like that are the reasons some of us in Virginia are reluctant to push for a statutory Castle Doctrine. The antis can't do much about common law. But in the games politicians play, amendments to statutes can create a minefield.

    We have a common law Castle Doctrine on our side in criminal court -- with no need to retreat, no need to be in your home, no issues with time of day, no issues with windows being open, etc. LEOs, the Commonwealth Attorneys, and the Judges get it -- for the most part. I know of no case where the shooter had good cause to fear physical harm or death of self or harm to / death of other innocent party where the Criminal Court found against the shooter.

    OTOH, what we do need is a statute to protect us in subsequent Civil Court. Seldom, if ever, the Court finds against a righteous shooting -- but the cost of defending yourself can be a bear.
