    A legless man in a wheelchair who fatally shot a gun-toting intruder yesterday is unlikely to be charged, police said this morning.

    Rocco Bombara shot once after the intruder had fired two rounds from a rifle as he crawled through a window early yesterday at the Leland Point Apartments in Baldwin Borough, police Chief Michael Scott said.

    "Preliminary indications are that Mr. Bombara will not be charged," Scott said.

    Allegheny County police are investigating the shooting.

    "He was super lucky he's still alive," Nicco Bombara, 18, said of his father. "We're all still alive."

    Pronounced dead at the scene at 2:05 a.m. was Lairy Evans James-Watson, 19, according to the Allegheny County Medical Examiner's Office.

    Rocco Bombara was taken to UPMC Mercy, Uptown, with a gunshot wound in the hand. He has been released, a hospital official said today.

    James-Watson's sister Stephanie James told WPXI-TV that he died on his 19th birthday.

    "I want everyone to know that he wasn't as bad as how everybody is going to portray him," she said.

    "He was a good person, a good brother, a good uncle.

    He worshipped my daughter, and my daughter loved him." <~~~(Happy Birthday! - His Birth Day Unfortunately Was His Death Day...poor baby! He was such a GOOD boy...he only shot at & tried to kill some poor guy in a wheelchair while he was breaking in to do an armed robbery on the wheelchir bound man that was in his own house watching TV and not bothering anybody...he only wanted to rob and kill some innocent human being so that he could buy himself a little birthday present! Boo Hoo Hoo but, he wasn't a BAD boy...and he LOVED his Daughter only he just didn't give a damn about anybody else. And for certain he's not as bad as QKShooter thinks he is....Whoops!....was.)
