    Class A misdemeanor

In 2012 I was arrested and convicted of NYC penal code 165.71 class A Misdemeanor of Trademark Counterfeit working as a street vendor, I served two days of community service.

I am planning on moving to Phili, Pa. in the near future, and as a 2a proponent, I am curious to know how this will effect any gun purchase or receiving a carriers license.

    Thanks for help.

If this is the wrong place for this post, please accept my apology.

Semper Fi. - seek cheap (if you can find cheap) legal counsel.

The issue is, are you of a prohibited class? I don't think so........... but then again, as Paul Harvy might ask.......... and the "rest of the story" is?

Go online and download a copy of the PA firearms laws. There is very likely a section on the requirements and disqualifying criteria. Use that as a starting point and then consult with an atty to confirm. If you should run into problems, having previous contact with an atty on the subject will help facilitate your moving forward.

Welcome to the forum. If you dont mind I'd ask what exactly was your disposition. More often than not non violent misdemeanor's plead out may result in community service with an ACD. An ACD is a Adjurnment with the Contemplation of Dismissal. This means that you stay out of trouble for 6 months or a year depending on the Judge, and the case against you is dismissed. It's important that you find this out. I'd bet you dont have a misdemeanor conviction on your record. The good thing is you can have a lawyer apply for an ACD. The trick is to stay out of trouble. I really hope this works out for you in a positive manner.

    Good Luck

I am not a nutrition scientist nor do I play as one in RL. I've always figured a misdemeanor was one small bump worse than a traffic ticket but no more than that. I would go with ANGLICO's advice+what Mr Noway2 said. Unless you speak lawyerese you will need an interpreter. I always have.

You might want to wander over to New Members Introduce Yourselves and say howdy. Meanwhile Howdy from NONAME762. Moving AWAY from NY state is a win win in anyone's book.

This is from the PA website about Conceal carry; "If the PICS check is approved and the subject is of good character, the sheriff may issue a License to Carry Firearms. " It will all come down to if the sheriff thinks that what you did, makes you a person of bad character or not. So I am going to say this one is a toss-up. The best solution would be call the sheriff's office, explain the situation and see what they say.

A Class A misdemeanor is one step below a felony. That's awfully strong for a Trademark Counterfeit as it is usually reserved for weapons charges or violent activities.

In Texas it prevents you from getting your CHL for 10 years if I am not mistaken.

IANAL! Consult one or at least read the appropriate state's laws in great detail. And as stated above, once you have an understanding of the law contact the local Sherriff.

    Welcome to the forum.

As to your question, you probably need to talk to a PA. based lawyer. They should be able to give you the correct answer your looking for.

Its 5 years from date of conviction, and were pretty pro gun,in MAY Issue States that would probably prevent you from ever getting a license to carry

In new york a crime is a misdemeanor or a felony. There are criminal violations that are not a crime. An A misdemeanor is a fairly significant crime.

Well, legally it's significant. But in New York picking your nose without a permit is a significant crime.

It depends on who does the approval. Here it is the county Sheriff, personally. I had a bunch of minor stuff from way back, he said he didn't care since that pattern changed long ago but he called me in to size me up, no problem and made another friend.

Just curious--- you said you were convicted of --"class A Misdemeanor of Trademark Counterfeit working as a street vendor,"

Does that mean you were selling knock offs, e.g., $5.00 designer stuff, or does that mean you had a push cart named
McDonalds from which you sold burgers?

I'll reserve any further comment till I learn what it was you actually did.
