WARREN, Ohio (AP) — A man has pleaded guilty in the accidental shooting death of his 7-month-old half brother during a drinking binge.
David E. Young, 20, of Warren, pleaded guilty Monday to involuntary manslaughter in the death of Adam Gunter at home on Dec. 3, 2005. Under the terms of a plea agreement, he could get one year to five years in prison.
Assistant Trumbull County Prosecutor Chris Becker told Judge W. Wyatt McKay that Young was handling a sawed-off shotgun, aimed at a wall and fired. The blast struck the infant in the abdomen as he slept in a crib in the next room, killing him. Becker said Young has admitted that heavy drinking was the reason for the accident.
In exchange for the plea, prosecutors dropped weapons charges.
So, this guy, gets drunk (underage) and used his illegally modified weapon to kill an infant, and he is going to get 1-5 years?
Does that seem wrong to anyone else? I saw this and I am pretty much appalled and speechless.

I imagine living with what he has done will be a big punishment already. 1-5 isn't much alright. Society will also condem this person for his own stupidity.

The sad truth is he will serve closer to the 1 than the 5! There is a solution to this problem and it doesn't involve building new prisons.

Be a law-abiding citizen in defense of your life, you risk spending the rest of your natural life in prison if you get it wrong. But kill a baby in its crib, you can point your finger and blame something ("drinkin' made me do it") to effectively get the wrist slapped. The rationality of the laws is hard to follow. By design, perhaps.
Your best weapon is your brain. Don't leave home without it.
Thoughts: Justifiable self defense.
Explain: How does
disarming victims
reduce the number of victims?

What a crock of crap! This moron needs to be doing 20 to life! We as a society really need to take a hard look at our "justice" system. It really seems screwed up to me sometimes.

Rocky, if I may push your buttons a little, living with what he did is not a punishment at all. It is simply the consequence of his actions. Too often, our system fails to adequately hold people acountable because we sympathize with the "punishment" that will come from living with the event.
The trouble with that thinking is that it has absolutely no deterent potential. The other sawed-off-having low-lifes are not going to say, "I'd better not drink and play with my gun, because that last guy is feeling really bad about what he's done, while he out on the street living his life."
If I climb your fence to steal your stuff and your dog bites me, the dog bite is NOT a part of my punishment, it's a consequence of my crime. Even if I lose a foot to the dog, that fact should in no way lessen the punishment for my crime.
The classic example is the Menendez brothers' defense attorney saying, "These poor boys have suffered enough. They've lost both their parents." They didn't lose their parents, they murdered their parents. Being orphans is not a part of their punishment, it's a part of their crime.
My 2 cents. (OK, my 6-8 cents)

All the time. When you get a longer sentence for tax fraud than rape or murder the system is beyond broken.

I agree. Had he not shot the child, not been drunk and not had a gun but DID have a kilo of coke and trying to sell it out of the home, he would be in jail for 10-15.
This country puts more drug sellers and users away than any other statistic. They are in jail longer and often times do not get parole as easily as voilent offenders. Atleast in Oregon. I cant speak for other states but I have seen first hand a meth seller get 10 years and a rapist get 5 years of prison but was released after 3 due to the "rehab" program he completed while inside.

Booze and guns don't mix. Its a shame that somebody his age is that drunk. They should have prosecuted him for the sawed off shot gun. I wonder where the rest of the family were. Maybe the rest of them were in the same condition. the judge sure messed up on this one. He probley felt sorry for the 20 year old. Handleing a firearm while intoxicated should be handled the same way as drunk driveing but the penalty should be far more severe.
