JONESBORO, Ga. (AP) -- A newly elected sheriff who deployed snipers on the roof of the jail on his first day in office and then fired more than two dozen people will comply with a judge's order to rehire them.
But a lawyer for Clayton County Sheriff Victor Hill said the employees won't actually be allowed back on the job until a judge decides whether the firings are legal.
"Until a date is established and a decision is rendered as to the status of those employees, they are at this moment placed on administrative leave with pay," attorney Evan Kaine said.
But that decision may prompt another legal fight. Harlan Miller, who represents the employees, plans to ask Clayton Superior Court Judge Stephen Boswell to hold Hill in contempt of court.
``He was ordered to reinstate these people to their jobs," Miller said. "We will ... take the steps to make sure the sheriff is in compliance."
Miller and Clayton County Commission Chairman Eldrin Bell say Hill cannot place the employees on administrative leave with pay.
"We have a policy in the county, but it's only been used by the Police Department in police shootings," Bell said.
Sheriff Hill fired the employees Monday as part of a plan to change a department he says was "dysfunctional." The employees were summoned to the county jail, stripped of their guns and badges and handed photocopied letters of dismissal. Sheriff's Department snipers stood guard on the roof of the jail as the workers were escorted out.
Hill claims the employees were not protected by the county's civil service merit system and could be fired at will. Bell disagreed and sought the injunction from the judge.
Hill defeated former Sheriff Stanley Tuggle and two other opponents in the sheriff's race in July.
Hill is a former state legislator and police detective who clashed with some county commissioners and a local police chief before running for office. While in the Georgia House, Hill unsuccessfully pushed a bill that would have put Clayton County's police operations under the command of the sheriff's department.
Retired Superior Court Judge Ben Miller will hear the case on the legality of the firings Jan. 14 in Clayton Superior Court.
Meanwhile, George Mark Tuggle, the brother of former Clayton Sheriff Stanley Tuggle, was released from the county jail Wednesday on $2,400 bond. He was charged Tuesday with making harassing telephone calls to Hill.
