Bakersfield police cleared in firing 62 shots at man
The Bakersfield Californian | Friday, Sep 7 2007 10:21 AM

Seven Bakersfield police officers who fired 62 shots at 24-year-old Jesus German Sarabia on Aug. 27 acted properly “to protect their lives and the lives of others,” the police department announced today.

The officers and four Kern County sheriff’s deputies fired more than 100 shots at Sarabia, also known as German Cohen, who reportedly refused to drop his gun in the backyard of 2602 Lake St., officers reported. Sarabia was killed by 34 bullets which struck him.

The sheriff’s department was conducting a news conference at 10: 30 a.m. to announce the results of its shooting review board in the same incident.
If the Sheriff's Office has a different ruling, I will post it, but I suspect they will have the same conclusion.

So where would excessive force begin? Round 150, 200?

Excessive force would begin right after the first round fired after the threat had ceased. 100 rds/11 shooters = 9 rounds a shooter. How fast can you crank off nine rounds when someone is pointing a gun at you?
A man fires a rifle for many years, and he goes to war. And afterward he turns the rifle in at the armory, and he believes he's finished with the rifle. But no matter what else he might do with his hands - love a woman, build a house, change his son's diaper - his hands remember the rifle.

Wow.....I've been to Bakersfield many times, it's strange to read about it here.

He should have dropped the gun, huh?

They're not too kind to Thugs in general. We (Madera County) are even less tolerant of THUGS.

eh legalities...I'm of the opinion that once someone has demonstrated that they mean to harm you or yours... that there's no such thing as excessive force.

The BG put himself there. He got what was comming to him. When the bad guy has a gun pointed at you its not time to ask questions. I guess a lot of cops there wanted to go home after their shift was over

    No mercy for a BG...
    With a gun? Even less...
    Only 9 shots per cop?
    Sounds fair to me...

Most people who scream EXCESSIVE FORCE don't put themselves in the officers shoes. They were pursuing this man who was armed and would not put down something that can kill anyone in proximity. I guess they wanted LESS cops to respond, and LESS bullets to be fired to save their own lives. I wonder if these people would have stopped before shooting and said "now how many rounds should I fire at this guy? what will look acceptable to the general public in the news tomorrow?" I DONT THINK SO!

We all know cops must say, "It's him or me..." regardless if there is 1 or 27 standing in a backyard.

That's what I understand to be the rational standard. So long as there's an ongoing lethal threat, it's just as threatening at bullet #24 as it is at bullet #1 ... so, keep on going. Once the threat ceases, however, stop. In the instance of the guy refusing to drop his firearm when demanded police to do so, well: he did it to himself.
