Former Border Patrol Agents Up For Resentencing - News Story - KFOX El Paso
EL PASO, Texas -- The U.S. 5th Circuit Court of Appeals has ordered the resentencing of two former border patrol agents.The two agents were convicted of shooting a man near the U.S.-Mexico border.The resentencing was ordered after tossing out the agents' convictions for tampering with an official proceeding.Ignacio Ramos' resentencing will be Nov. 13 in El Paso, and Jose Compean's will be Nov. 12.The two were originally sentenced to more than 10 years in prison for shooting Osvaldo Aldrete Davila in 2005.
Maybe the will get off with time served.

Just want to make sure i understand what happened.
They were convicted and sentenced in '05, have been serving their time and appealing the case. Now the appellate courts have decided to re-sentence them in Nov? I am assuming this is in their favor? Or am i misreading this.
The muzzle end of a .45 pretty much says, "Go Away" in every language.
Fast is fine, accuracy is final. Learn to be slow in a hurry.

Yes this would be in their favor, right now one is serving 10 years and the other 12 years, if I remember correctly.
You can google their names and all the info is there.

Of course, I'm really steaming over Aldrete Dávila getting a visitor's visa out of the deal, and the audacity of him suing over a violation of his civil rights

Unless I'm misunderstanding something, this guy was not a U.S. citizen, and had no legal right to be in the country, as i gather from reading he was issued a Visa for testifying against the two BPs.
Why should he be allowed to sue for a violation of "civil rights" he was not previously legally allowed?

The issue is that they were charged under 18 USC 922 (if I remember correctly) Carrying firearms during the commission of a feloney, which was designed to put away BG carrying guns. While I will argue that they weren't "innocent" in their actions, this charge should have never been filed. THAT'S why they got so much time, under minimum/mandatory sentencing.

This should never have been an issue, shooting a drug smuggler... fleeing from the law as I recall... I hope they are released and get full back pay and their jobs back if they want it.

If you want to be outraged even more, look into the fact that one of them was placed in a federal prison in Mississippi with locked up illegal aliens. That agent was beaten nearly to death when they discovered who he was. I think everyone involved in prosecuting this case should have to serve time.

I hope they get time served, back pay and Tim Sutton gets indicted for railroading the two.
