Thumbs down Ninth Circuit Strikes Again!

Here's the Ninth in action again. The next thing you know, they'll give Felons the RKBA..........

Ninth Circuit Decision Yesterday on Felon Voting
The Ninth Circuit ruled yesterday that it is a violation of the Voting Rights Act for the State of Washington to disenfranchise felons, due to racial discrimination in the state’s criminal justice system.

Oh, where to begin? First, the evidence of systemic discrimination is dubious. Second, even if there were such discrimination, the record is overwhelming that Congress did not intend the Voting Rights Act to apply to felon disenfranchisement. Third, even if the Voting Rights Act did apply, the state’s legitimate and strong reasons for not wanting criminals to vote would rebut any prima facie case. Those who won’t follow the law themselves can fairly be told that they will not be allowed to make the law for everyone else. We don’t let everyone vote — not children, not noncitizens, not the mentally incompetent, and not criminals — since there are certain minimum, objective standards of responsibility, loyalty, and trustworthiness that we require of those who would participate in the serious enterprise of self-government. The Center for Equal Opportunity has devoted part of its website to this important issue.

Well, here’s hoping the Ninth Circuit will rehear the case en banc. If not, the Supreme Court will likely grant review, since yesterday’s decision is in conflict with those of other federal courts of appeals.
    This is beyond the pale................Scheeeeeeeshhhhhhh

Wish I was a Judge for the Court of Appeals!

If this stuff keeps up, a felony will be like getting a speeding ticket.

So because the majority of felons are minorities (D WA), they are gonna let them vote...That just makes tons of sense.

Only they still won't be able to have guns. And if the 9th Ckt Ct had it's way, you wouldn't be allowed to have guns if you got a speeding ticket either.

State plans to appeal ruling on felon vote
"Washington state will appeal to the U.S. Supreme Court in an attempt to overturn a surprising federal-court ruling that tossed out the state's 120-year-old prohibition against voting by incarcerated felons, Attorney General Rob McKenna said Wednesday."

It's Ninth Circuit. It will probably go away soon.
The preceding post may contain sarcasm; it's just better that way. However, it is still intended with construction and with the Love of my L-rd Y'shua.

Thats all part of their plan; make the convicted felon look no different in the eyes of the law than any law-abiding citizen; then we all become equal - subjects, not citizens......

Ever wonder why the police refer to people as subjects??

Ahh, the wonderful queer court in San Francisco.

As has already been said, we are circling the drain. I just hope I can get out of this world before it's totally gone.

9th Circuit court legislates from the bench (again).

How socialist of them to circumvent the rule of law.

Hmm, and they can't figure out why threats against judges and prosecutors are increasing? People are fed up with this crap.

If these trends continue, our society is going to start breaking down. Once folks loose respect and the will to support the law and the government, the house will fall.

I know I may catch some flak for saying this....

But with America's ever increasing harsh laws for non-violent crimes, I think its okay.

Back when the term "Felony" was created, it meant an extremely violent crime.

Today, in some states its a felony to have certain ammunition or gun accessories.

Make a certain mistake on your taxes? You could end up being a felon. Some drunken pedestrian runs out in front of your car and you dont stop in time? You could be a felon.

Dont get me wrong, violent offenders and big time drug dealers should be felons and should NOT have the RKBA or vote.

But it seems like a growing trend lately in many states to make certain misdemeanor crimes into felonies.
