    New member form Arkansas with legal question

    Hi I recently purchased a transferable MAC 10 from a company in Florida. The dealer to dealer transfer was ok'ed and the gun is now at my dealers in Springdale Ar. When it arrived I started the Form4 process using a Gun Trust and everything looks great in the world.

    This weekend I am looking around, and I run into the Arkansas Uniform Machine Gun Act which I am pretty sure says that I am risking 10 years in the state prison if the gun ever leaves my residence or is found with any ammo used or unused..

    Can somebody please help me here?

    I looked and talked to 20+ dealers all who said that Arkansas had some of the most lax NFA rules! I was told I could hunt with a machinegun, take it to the range etc etc... Hell, I just wanted to be the guy at the range with the coolest toy! Are subguns legal in Arkansas, or are they only legal if they never leave your home and are never paired with ammo? Please see the Presumption of offensive or aggressive purpose portion of the law? This is all very heart breaking, and since the Gun cost almost $5,000 I am just really feeling low.

    Don't feel low. There is no reason for it.

    The law that you read will apply only if you try to shoot someone with your Mac 10. Don't try to shoot anyone with it and you'll be good to go.
    Take it to the range and shoot to your hearts delight.

    Since your Mac is registered on the Form 4, you have nothing to worry about.


    Just so you know, I am an 07/02 FFL and I deal with such things. That's sort of like your Class 3 dealer except that I get to fabricate,
    repair and sell Machine Guns, Short Barreled Shotgun, Short Barreled Rifles and even Suppressors.

    Yep. I read it when I got into the NFA world a few years ago.

    Never had any issues with it. Fact of the matter is, not a single cop that I have ever dealt with even has a clue about NFA law, unless I have educated them on it and I know most of them in Pope County. Along with the Judges, the Sheriff, and the Police Chiefs and Marshals.

    The statutes were written to enhance charges against someone IF they used a machine gun in the act of a crime. Most of that stuff came from the days of Prohibition when Al Capone and his cronies would hang out in Hot Springs. Back then, it wasn't unusual for someone to get crossways with the wrong gang members and get machine gunned.
