I was originally born in Dallas...moved away when I was 1 year old, lived in 2 different countries and 3 different states before moving back to TX in Austin at 28 years old. I had been living in NJ for about 17 years before moving back out here, and I'm hoping to enjoy some freedom I didn't have back on the east coast. I had 2 luxury goals to accomplish when I moved here. 1. Buy a motorcycle, which I've done. 2. Buy a handgun....which I'm about to do, hopefully.
I've been doing tons of web browsing on which handgun I might like to make my first. Took my lady to Reds Indoor Range in Austin and we both had a blast. Tried out 2 different .22 LR handguns one semi-auto and one revolver. I had read about the Glock 26 and I tried that too. Waaay more power in that 9mm. Probably not a great gun to try the 9mm caliber for the 1st time...but hey, it was fun.
Anyway, I do have a few questions since I'm concerned about my ability to purchase a firearm and obtain a CHL in TX.
At 18, I was convicted of Criminal Mischief in NJ (I believe it was this charge, might have been Petty...haven't looked at the papers in a while). Nothing bad, just a bunch of kids at a "haunted house" that took the rap for a group earlier in the week who had destroyed some items. We never even made it inside...Anyway, that can be expunged from my record so I'm not that concerned about it. I'm not even sure it would stop me from being able to buy a gun if it wasn't expunged since it was so incredibly minor and 10 years ago.
What does concern me are my two DUI's at 21 and 23 years old. In NJ these offenses are treated as traffic offenses and will not show up on a criminal background check. They only show up on my traffic record. My traffic record has been clean for 5 years and I haven't gotten into any trouble whatsoever. I am a much different person now than I was at age 22, that is for sure.
Will TX access my driving record when I attempt to buy a handgun and also when I apply for CHL? Or will they access my criminal record (or lack thereof)?
Thanks in advance, and I'm looking forward to responsible firearm ownership as it's something I've wanted to do for a while now.

Welcome from Virginia. In Virginia I think they go back 5 years on DUI's, good luck and I am glad you settled down. Like you I am not the same person that I was when I was young.

Welcome to the forum...not sure about the answer; perhaps a TX CHL holder and/or lawdog can sound off with an answer. They no doubt search NCIC (at a minimum), so the NJ convictions should appear; but since they aren't felonies, that alone shouldn't stop you from getting a CHL.....

I moved here from Austin a year ago. No, your traffic record will not affect you getting your CHL, nor will it affect you buying a handgun. It isn't a cheap or easy process to get your CHL in Texas though...You have to take a class and wait for it to come in the mail.....Here in GA, you pay 39 bucks at the court, they take your prints and run a NCIC on you....and then you get it in the mail....
A good idea for you would be to go up to Reds and talk to them about your CHL, they can fill you in with a lot of details...the guys up there are great. Off the top of my head, thats the only shop I trust in the Austin area...

I wouldn't think that they would go that far back, but I can't say for sure. I'm from TN origionally, and I know that they go 7 years back there.

If you have been convicted in the past 10 year of 2 DWI than you are not eligible. If it had only been one conviction then it would have been 5. Sorry.......but welcome to DC.
