    Been residing in Fairfax, VA for 3 yrs. now & always carry defense weapon back home. I been carrying an expandable baton for quite some time now in my purse. When I purchased the item on-line it didn't say anything that it cannot be shipped to VA so I'm assuming that its legal. Also, I have a pepper spray in my key chain, a 2 3/4" folding knife in my ankle & baseball bat in the backseat of my car, I don't think I would be in trouble for that as far as I know. I worked late at night on weekends and I'm just a legal resident alien.I been stopped once by cops coming from work this summer just for a routine traffic stop if I been drinking. I don't drink so I have no issue with that, its the baton I was worried about. Is legal for me to carry the expandable baton? And what are the consequences if I got caught?

    If discovered you may be charged with carrying a concealed weapon. I would note that per the code you may not carry your baton concealed even with a permit. It is considered a "spring stick" as in bold below. You may wish to consult a criminal defense attorney to determine legalities and also potential penalties. They would be much more familiar with the penalties given out and so on.

    Virginia State Police

    Virginia Code Section 18.2-308 - Prohibits the carrying of any pistol, revolver, or other weapon designed or intended to propel a missile of any kind by action of an explosion of any combustible material; any dirk, bowie knife, switchblade knife, ballistic knife, machete, razor, slingshot, spring stick, metal knucks, or blackjack; any flailing instrument consisting of two or more rigid parts connected in such a manner as to allow them to swing freely, which may be known as a nun chahka, nun chuck, nunchaku, shuriken, or fighting chain; any disc, of whatever configuration, having at least two points or pointed blades which is designed to be thrown or propelled and which may be known as a throwing star or oriental dart; or any weapon of like kind by any person hidden from common observance about his person. Any of the enumerated weapons shall be seized and forfeited to the Commonwealth. A weapon shall be deemed to be hidden from common observation when it is observable but is of such deceptive appearance as to disguise the weapon's true nature.

    And welcome to the forum.

    That's only if the baton expands suddenly and forcefully by means of an internal spring - this statute does not include those that have to be pulled open or which open by gravity or by centrifugal force when swung in an arc. If it does use a spring then, yes, it's carrying a concealed weapon, and the concealed handgun permit will not cover that.

    I used to keep a baseball bat in my car when I lived in Illinois. I spoke with a friend who was in law enforcement, and he told me to just put a glove and ball in the back seat with the bat.
