    DAYTON — A preliminary investigation regarding Tuesday’s homicide at Maylin Apartments at 2701 N. Gettysburg Ave. reveals that the shooter was justified in shooting two men he said tried to rob him, according to Lt. Patrick Welsh.

    However, detectives plan to present charges to the Montgomery County Prosecutor’s Office.

    “We’re still looking to talk to additional people,” Welsh said.

    The shooter has been identified as 45-year-old Terance F. Boyd.

    Even though the shooting appears to be justified at the moment, Boyd was still arrested at the Dayton Safety Building and booked into the Montgomery County Jail as of 4:01 p.m. Tuesday, pending a probation violation, according to jail records.

    Boyd was taken into custody by adult probation because there were drugs found in his apartment, Welsh said.

    The shooting occurred shortly before 11 a.m. Tuesday, June 1.

    Boyd told police that he shot two men because they tried to take his money and some drugs, according to a Dayton police incident report. One of those men died at the scene. He has been identified as Timothy “Baba” Thomas, 41, of 1704 Woodward Ave. in Springfield. His cause of death had not been determined as of 10:30 a.m. Wednesday, according to the Montgomery County Coroner’s Office.

    James A. Schooler, 50, was wounded in the shooting and taken to Miami Valley Hospital. Schooler was listed in fair condition as of 10 a.m. Wednesday, according to a hospital official.

    In 2009, Montgomery County Common Pleas Court Judge Gregory Singer sentenced Boyd to five years of community control after Boyd was convicted of improper handling of a loaded firearm in a motor vehicle with no license and having weapons under disability due to a prior drug conviction. In March of this year, the court decreased Boyd’s community control from intensive to basic probation supervision.

    Well, it thins the herd and saves public money, keeping them from reproducing disadvantaged misguided uncouth youths.

    Maybe the cause of death was lead poisoning?
    The first rule of self-defense is to avoid the situation. The second rule is Train and Prepare.
