    Shooting of officer is ruled justifiable.

    This was in the Sunday Arkansas Democrat. Diamondhead is a gated retirement community outside of Hot Springs Arkansas. An off duty Diamondhead officer was shot in the shoulder on July 21 in an exchange of gunfire after an attempted traffic stop "used poor judgement" in his agressive pursuit of a driver, and her husband was justified in shooting the officer, Garland County Prosecuting Attorney Steve Oliver determined in a ruling released Friday. Basically, the officer(Fred Ensminger) says the driver(Cindy Nelson) crossed the center line, almost caused a head on collision, and he tried to pull her over in his personal truck, equipped with red and white flashing lights(not activated). She refused and he followed her home where her husband(Jerry Chambliss) came out angry,shouting, and slammed on the hood of his truck and told him to leave. Ensminger claimed he never got out of his truck, and when he showed the man his badge, that the man shot him without provocation, and he returned fire in self defense. When troopers went to the home, Chambliss was detained without incident and said, "the officer shot first and the gun is in the garage," where it was found unloaded. Chambliss later told investigators that Nelson called him and said,"a man was pursuing her aggressively. He said when the truck arrived he went out to meet the truck with "his hands up, palms out, hollering, stop,stop,stop, what are you doing?" He said the truck continued, striking him and knocking him down. When he got up the man got outta the truck with a gun, so Chambliss went inside to get his gun as the man fired, hitting the garage. Chambliss said he returned fire and the man backed out of the driveway and left the scene. Investigators said that Chambliss'sshell casings(9mm) were found where Chambliss said he was standing. Ensminger, who said he never got out of his vehicle was using a .40 caliber and a shell casing was found on top of his truck and one in front of where his truck was parked. Attorney Oliver said that a witness "stated he never saw a badge from the man in the truck," and his account agreed with the accounts of Chambliss and his wife. Although Chambliss was taken into custody, he was released without being charged. Niether party was charged in the incident. Oliver stated that "Chambliss was on his property when he used deadly physical force and under Arkansas law not required to retreat if he was not the original aggressor.
