    NY city is a 5-6 hour drive from here. I wouldn't even know it existed if I didn't own a map. There are plenty of sleeze here though. I've done some traveling and I think everywhere has it's share of dirtbags.

    A Monroe County grand jury has cleared a Rochester bar owner of any potential criminal charges for the fatal shooting of an armed robber in July.

    John "Paddy" Kitzel, 71, will not face charges for the death of Barry Woods, 38. Police say Woods tried to rob Kitzel's restaurant on July 6. Kitzel shot Woods in self defense.

    Woods was wearing a mask when he entered Kitzel's establishment during the lunch hour brandishing a pistol.

    I don't know if it's required (I doubt it), but it was be negligent for the PA not to put the shooter on a stand and testify. Sure, sounds like a justified shooting, unless there was something going on that we don't know about...say a drug deal gone bad and the bar owner stealing the money or something. Of course, I doubt that happened, but with no witnesses, the PA and the policy should at least look at it.

    I think in general, this is a formality. In most states that I am aware (although I am NO lawyer), a refusal to indict, or no true bill, whatever the particular state calls it, prevents future prosecution of the shooter (double jeopardy). If involved in a similar situation, given my county's District Attorney General's position on crime, I would want the case presented to the grand jury to be cleared as justifiable. In TN, this would also prevent any civil suit against me, according to TN law.

    I would have thought that no witnesses + perp's gun on the floor would = no need for a grand jury. There is no one to counter the say-so of the bar owner that the guy tried to rob/hurt him! What the he)) is with this need to have a grand jury weigh this, costing the man thousands of dollars in legal fees, probably?!

    Is it not so, that when you appear before a grand jury, someone from the DA's office is going to be standing there trying to argue that there is a case to be made against you? That you committed a crime? Where is the evidence that there was a crime committed? Sure there's a body, but there's a statement by the defending shooter, plus a gun brought by the decedent, found at the scene. Why hassle the guy with a grand jury?!
