    The only thing I miss about upstate NY is the finger lakes. Cayuga is a beauty and possibly my favorite. Oh yeah, that and the Adirondacks.
    People always say that, but since I've lived in the Syracuse, NY area there have been at least 4-5 dead bad guys... shot by homeowners...

    In one case a woman returning home found a man in her house, she pulled her gun and killed him. So far in every case no charges were filed against the homeowners... and in all but one case, the robbers were unarmed, one guy had a knife, and one had a hammer IIRC...

    My point is I've not seen a case yet where the homeowner got in trouble, not in the last 10 years.. if it happened I somehow missed it or it was outside my news area....

    If you have an anti-gun DA you will had problems regardless of the intent of the law. If the homeowner perceives that he will be treated harshly for attempting to protect himself it probably will affect how he responds.
    Just look at what the School security said the other day after he shot and wounded the person who was shooting at the school council. He said he thought he might be arrested for what he did.

    That is a possibility in homeowner response.
    For a retired police detective, his reaction IMO, was a poor understanding of the law.
    A DA could conceivably charge anyone with anything, that's life.
