    It's OK to carry a gun in The Bronx -- as long as you're a gang member, several jurors apparently found yesterday.

    Kenny Tavarez, 22, a self-professed Bloods associate, claimed on the witness stand last week that he was packing heat for "protection" since he had just been shot twice in the past six months.

    But jurors yesterday deadlocked on whether to convict him for carrying a loaded weapon even even though Tavarez admitted on the witness stand last week he admitted to the crime while on the witness stand.

    "I can't believe this. It was a cut-and-dry case," a law-enforcement source told The Post.

    The DA's Office has vowed to retry Tavarez.

    So - double jeopardy does not apply in NY??? Jury probably figured the defendant's buddies would find them and that was not in their best interest. Jurors need to grow some cajones or society as we know it is doomed.

    Jury was deadlocked. A Not Guilty would they apply to double jeopardy. Maybe people views about gun ownership in NY are changing for the better.

    It is easier to buy an illegal gun off the street and carry it than doing the right thing and getting licensed.

    Consider the jury pool. The hung jury has nothing to do with peoples attitudes about guns. All it takes to hang is one juror who is part of the gang culture or one juror who is afraid to convict.

    Jury nullification definitely at work, which I like, but in this case he's saying he's in a gang which is a deal breaker to me.

    Recently, a NYC jury gave a NG verdict to some dude from Florida that came to the Big Apple to help his GF move, and got caught with a gun in his truck.

    There is hope yet for NYC!

    Some states' societies are already pretty much doomed, this would be one of them.

    This is a real bad outcome for law abiding citizens and good for the poor, downtrodden, abused, no other choice in life thugs that help give guns a bad reutation.
