    Why isn't he being tried for murder? He took part in a crime where people were killed.

    There could be several reasons.

    First off the feds took this case rather than Fairfax County/State of Virginia. That could limit federal charges options. There may not be a federal felony murder statute that covers such a crime not on federal land. I don't know for sure.

    The feds may be more likely to secure a conviction based upon the available evidence and the elements of the crime that need to be proven. The federal charges are essentially robbery with an interstate commerce aspect.

    Each count carries a 20-years possibility.

    As best I can tell Jelani Slay wasn't indicted because he is the Jelani Slay that got smoked by an off-duty cop in 2009 during another armed robbery he was in the middle of.
