based off the article it seems that the gun stayed in the holster but was displayed on her hip.

Open carry is legal in Va.
It happened about 3 mins from where I live. My brother use to live on that street.
She made the news again tonight. She used her car to block a school bus and had words with the bus driver. I think she was arrested again .

Bus stops are not school property.
OC is legal in VA and they have a pretty specific brandishing statute IIRC.
I don't like the fact that LEO's seem to be allowed to press gun related charges, even if they don't fit. Just charge her with something gun related seems to be what's going on. Or poor reporting.
But if your dumb enough you'll find a way to get arrested it seems. Blocking a school bus, wow.

Just shooting from the hip but she may have made a big fuss about her son being bullied the day before this happen then today she OC a gun and got the whole, "what are you going to do with that thing" spill and things got carried away. Just a thought.

This is the brandishing statute:
LIS > Code of Virginia > 18.2-282
§ 18.2-282. Pointing, holding, or brandishing firearm, air or gas operated weapon or object similar in appearance; penalty.
A. It shall be unlawful for any person to point, hold or brandish any firearm or any air or gas operated weapon or any object similar in appearance, whether capable of being fired or not, in such manner as to reasonably induce fear in the mind of another or hold a firearm or any air or gas operated weapon in a public place in such a manner as to reasonably induce fear in the mind of another of being shot or injured. However, this section shall not apply to any person engaged in excusable or justifiable self-defense.

I think chiefjason summed it up the best. I agree with you that pressing charges on a gun related matter that doesn't fit is not good. The media will eat it up.
She didn't seem smart in any case. She probably mouthed off something that made people nervous.

It's unclear what else transpired at the stop as to whether she was just open carrying or if she was open carrying and spouting off in some 4-letter colorful metaphor laced diatribe and alluding to her openly carried firearm. I'm thinking it's along the lines of the latter based on her interactions with the media and this latest stupidity(bus blockade)... She doesn't appear to be the brightest bulb in the pack at this point.
