GOOD: Home owner shoots burglars, kills 1

Hopefully, the home owner will not be charged. He could poss. claim that when one of them came back (to retrieve a shoe) that he was in fear for his life and safety.

As long as they are headed away, fine. They turn around and come back, all bets are off. I am officially afraid for my life. I can't take a chance on their motives for returning. IMO the worst thing he did was to fire warning shots.

not sure how an area like Detroit will see this one.

What I see wrong with this:

He fired warning shots. Could be charged for discharging a firearm.
Shot at someone because of a vehicle that he was NOT in.

This doesn't look good for the homeowner, sad to say. He may have prevented these two from ever doing it again but he may have cost himself some time in the can.

Yah, the mother of the scumbag who died wants the shooter to go to jail! Naturally--her baby boy wasn't a crook, just a poor misguided good boy! Yah, right! Why is it the scumbags are always "good boys" and it is the fault of the honest citizens that they are attempting to victimize who are in the wrong? It's always someone elses fault that you get your butt blown away while you are comitting a crime and the honest citizen should go to jail!!!

In my state this would be BAD for the shooter. Breaking into a vehicle and then being shot by the vehicle owner--BAD. No threat to life that I can see. The difference here is that if the same guy was pouring gas on my vehicle (attempting arson) in my drive way, I can shoot. Sounds strange, but it's true.

Don't you just LOVE the part from the dead guys mom? Priceless!!

In Texas this would be a justified shoot, I am not sure about MI law.

I'm not a lawyer, but morally I make this argument

I spend a portion of my limited life to make the money to buy the stuff I own.
If you steal that stuff from me, you are ending that portion of my life.
You are killing me to a lessr degree.
Therefore if I shoot at you, I am doing it in self-defence.
You make the descision whether the mental and legal consequences are worth it,
but I can't condemn it on a moral basis.

On a side note: Don't shoot warning shots into the air... bullets come down.

If you're going to shoot warning shots, shoot into the ground or a tree or something.

ummmmm..heres an observation Why ain't the girlfriend in jail, she was in the "Getaway Car"!!!!!!!!!!!!!!!!!!!!!!!!!!

And someone should inform his mom that "JUSTICE" has been served..on her son!!!!!

Why is it the family members think are just as dumb as the criminals?....never mind don't answer that.

and as for the shooter it sounds like he has no training at all

So you can shoot at fleeing suspects? I understand in Texas you can protect property, but in MI you cannot. I would like to see that in Texas you can shoot at a fleeing BG...

Made in Detroit, this is what we do !

Sad to say ..... but this is a common occurrence in the big D today... The police are no where to be found (it's not in the city budget) and by then, it's too late. You had better make your shots count, and be within the law ......

"It just got to a point were we just had to take action for ourselves. It was just happening too frequently," said Hector Martinez.

That statement doesn't sound like self defense to me. Mr Martinez talks too much. Hope he knows a good attorney. He could very well need the services of one.
