Police Officer Found Not Liable For Shooting Death
This incident happend in Huntington, WV in 2009. It involved a group of black guys and girls who got into a gunfight inside and outside of the Club Babylon. One of the girls involved had got a gun past the club's security/bouncer and that was used in the shooting melee.
HPD responds and the guy who got shot and killed by the officer (police officer is white) was coming out the back door when he encountered the officer. He was armed and did not either understand or failed to obey the commands by the officer to put down the weapon. The information on the participants was so sketchy when the cops arrived, they didn't know this guy was not a part of the fight. This officer had to assume he was one of the shooters no doubt.
The brother of the dead guy stated he felt that HPD had been "targeting" them because they were black, but no charges of racism were ever filed, even the local NAACP chapter got involved and attempted to quell some of it.
The family did sue the HPD and the officer for the shooting, but he was found not liable.

Kuratomi reminded jurors that three police officers testified to having seen Porter with a gun. He then argued the plaintiffs provided no contrary evidence to say where the handgun came from.
This is where the plaintiff for the deceased lost the case.
He couldn't argue the fact that even though they said his client,(the dead guy) didn't have a gun, they couldn't prove that, or where it in fact it came from.
Glad the officer and the department are off the hook.
This is one of the reasons I tell my kids to NOT be in places like this.
Sometimes it ends badly for someone.
