Ugly just got uglier - "defensive" shooter charged 3 months later
Original story and thread from back in April:
Bad: Taco Bell shooting victim holding leash when shot
Guy is in the drive-through at a Taco Bell in Phoenix with his pregnant girlfriend. A guy walking his dog stepped in front of the first guy's vehicle, causing him to slam on the brakes. From there it degenerates into he said-she said; lots of yelling, guy in car said he saw a bat or similar weapon, said he feared for his life, drew his weapon and shot the dog walker, killing him. No weapon was found, and the dead man was somewhat mentally impaired, with the mental capacity of a 12 year-old.
Now the shooter has been charged with 2nd degree murder:

honestly...this guy deserves it. we all have a responsibility for proper target i.d. in events like this.

If I recall correctly, the guy could have just drove away. Even if the "perp" was armed with a bat (which was not found), at most in driving off he might have gotten a dent in his truck or a busted window. IMO not worth taking a life over.

One thing we are taught in class here in Texas is "being the adult “when something happens be the bigger and walk away or defuse it. This guy was in his car and he gets into a shouting match with a mentally impaired person and shoots him…please

Looks like he's going to pay a pretty stiff penalty for a bad decision!

We OWN every bullet that exits the muzzle. He was in a car...AKA a 3,000 lb. weapon he could drive away. Just Google Clint Smith on vehicle defense...
I spend a lot of mental time on Situational Awareness when I'm out and about, which includes things like, "If THIS happens, how can I get out of the situation without using my gun?

We also have laws against escalating a confrontation,we are taught to try to de-escalate and walk away instead of provoking an incident and then try to claim we were in fear of being harmed so we shot the guy

Unknown exactly what occurred. Perhaps the jury'll get to hear the majority of it, hopefully corroborated by independent witnesses.

Big difference between thinking one sees something, fleetingly, and having a weapon overtly and obviously deployed in the initiation of an attack.
Sad, how so many in this world appear to take being ticked off at another as tantamount to having reasonable belief that one is in jeopardy of loss of life, let alone that any attack is occurring.

Not for nothing, but the guy is driving a car and he was responsible for making sure that his path was clear...in a parking lot, no less. Pulling the gun after having his car smacked is just an out-and-out fail.

I agree with everything right up to the part I highlighted in bold. Unless the shooter knew it was a mentally impaired person he had encountered it should not be an issue or evidence of guilt.

This was the one where the Minority shot the White Guy, at the same time that Jessy Jackson et al were screaming about Travon..... It got no press.
The shooter in AZ needs to go to jail, in my opinion, however, he will get the chance to plea a bargan or be judged by a jury, the USA American way!

I'm sure Jesse and Al will be showing up soon accusing the sheriffs office and DA of racial profiling, making the claim that if it had been a white man shooting a black man no charges would have been file. Well have to listen to them crying out: "There ain't no justice for a black man!!" A little thing like facts will not come into their argument.
