    My Comments: This one has a lot of moving parts and is ugly all around. Who is the BG? One had legal carry, the other was revoked.

    ....Benn's statement is at odds with information released by police, who gave the following account: Benn accused Colorado of cutting in front of him and they began arguing just after 2 p.m. Colorado sprayed Benn with pepper spray. Benn then drew a handgun and approached Colorado, firing at him. Colorado drew a handgun, returned fire and collapsed.

    ....Colorado, 42, was a former Norfolk deputy sheriff and auxiliary deputy in Chesapeake who was known for his online persona "Norfolk Dirt."

    ....Colorado was a Norfolk deputy sheriff from April 1994 to May 1996, when he was terminated, said Paula Miller, a Sheriff's Office spokeswoman. He later worked as an auxiliary deputy in Chesapeake. He was promoted to auxiliary sergeant in Chesapeake in 1998 and stayed with the office until 2008, according to a sheriff's spokesman and court records.

    ....Colorado was known in online communities under his Twitter and Facebook handle "Norfolk Dirt."

    ....Norfolk police arrested him (Colorando) on April 28 on an allegation that he was harassing a woman who coordinated an anti-sexual-assault rally called SlutWalk Norfolk. Colorado made a video of himself talking to women who participated in the march; the video, posted on YouTube, shows a Norfolk police officer telling him he is under arrest.

    There is insufficient evidence from the cited article to make a judgment here and I'd like to hear from current/former LEOs to get their take on this. My opinion is that if Benn had not physically attacked Colorado and was pepper sprayed and drawn upon (and shot) prior to pulling his own weapon, it is a clear case of Benn acting in self-defense. On the other hand, if Benn pulled his firearm in response to being pepper sprayed, and was only THEN drawn upon and shot by Colorado, the case is much less clear in my opinion. For me, in the latter case, it becomes a legal question of whether or not being pepper-sprayed justifies the use of deadly force and also a question of whether or not Colorado was justified in spraying Benn in self-defense in the first place The facts will emerge and only then will we know. In either case, this is simply tragic.

    These cases of rage, whether it be Rite-Aid rage or road rage seem to support what I've observed is that we've become and angrier society. I don't know if it's the poor economic conditions, the feeling of hopelessness over the future or what, but it's a terrible shame people act in this manner.

    Pepper spray is not something you use and stick around to see what happens, because it is not a threat stopper, it will only make he who is sprayed madder. If you use it are going to stay in the area you better take control of the subject you sprayed, because once it wears off he's going to do something and you aren't going to like it most likely.

    Hard to say, but it is known that one individual involved was a licensed handgun carrier with no prior criminal record, while the other was still carrying a firearm after having his permit revoked, ostensibly for commitment to a mental health facility. He also had a history of deliberate public confrontations.

    I'm saying if you are going to stay in the area you better have the guy you sprayed in cuffs before he recovers. So you would need to be LE. This is why I don't carry pepper spray if I do something it will have more lasting results.

    Just going by the article, Mr Benn was protecting himself from an armed criminal. Colorado was carrying a concealed weapon without a permit, which in VA is a felony. The police do not dispute the fact that Colorado was the aggressor who sprayed Mr. Benn with pepper spray first. The fact that Colorado is a former LEO has absolutely no bearing on the matter.

    Sounds like Mr. Benn could use the "some people just need shoot'n" defense. We'll have to be patient on this one to see how it turns out.

    Sounds like it to me, he was the aggressor and had a gun w/o a permit but they arrested the other guy for defending himself.

    What might come into play here is "mutual combat", word were exchanged and escalated the situation to the point he needed to pepper spray mr benn so if that is the case you can’t claim self-defense in some states

    Actually I think it DOES have bearing since he was TERMINATED!!! I would like to know WHY??? Was it excessive force, excessive rage, lying on reports....???
