Silva fired the weapon into the air shortly before the Sept. 27 attack and later was disarmed by his attackers. He said one of the men "bludgeoned" Silva with the weapon.

If Silva fired into the berm as they were leaving this action was wrong and I suspect a crime. The people fired upon should have reported this action or just keep on walking as they were trespassing. But when the trespassers returned and beat him to death they committed murder. Once the trespassers were out of danger, they can not return, attack a person and claim self defense.

I wasn't there & I can't know the details, but IMHO the unsubstantiated rifle threat & shot sure sound like legal wrangling by the defense attorney of the rotten ***** who went back to gang-beat a hunter...to death.

He didn't die until a month later. The autopsy isn't in yet so I suspect they are waiting on that before upgrading to murder charges.
I looked at the guys picture and he looks guilty ( only partial sarcasm ).

He did die, yes, back in October. Which makes it tough to understand why causing the death isn't in the list of charges, since causing harm via the group attack is.

It sounds like there is question as to who beat him and who beat him to death. They probably are going for the charge they can prove though I thought you could charge them all by association.
