"Niederhauser, who has a concealed weapon permit and was carrying a gun, confronted Cruz, ordering him to drop the crowbar, which he did, police said. The vehicle then backed out of the driveway and headed eastbound, and Niederhauser fired a shot, police said.
After the car left, Niederhauser used a cellphone to call 911.
When the first police officer arrived, Niederhauser turned his attention to the officer and Cruz ran to the backyard area. Niederhauser chased him and fired a shot into a field."
Sketchy data, but this doesn't sound like a self-defense shoot.

I agree after Cruz dropped the crowbar he is no longer a threat.
When you have to shoot, shoot. Don't talk.

Looks like both shots were after fleeing BGs. Kinda hard to be a threat when you're unarmed (presumably) and running away.

WOnder why he didn't block the car in the driveway.
Who cares if the occupants bolt, the car,(which might have been stolen anyway) would have stranded the perps & would have made it easier for the cops to round them up perhaps.
He will probably get probation, and lose of his permit for awhile.
