    1st Arrest Under NY SAFE Act........

    Western NY man is 1st arrested under NY's SAFE Act

    7:10 AM, Mar 15, 2013


    HANOVER, N.Y. — Authorities say a western New York man apparently is the first person to be charged with violating the state’s gun-control law.

    Local media outlets report that state Attorney General Eric Schneiderman says 32-year-old Benjamin Wassell of Silver Creek was charged Thursday with felonies related to the sale of illegal weapons.

    Schneiderman says he twice sold weapons that are prohibited under the New York Secure Ammunition and Firearms Enforcement Act, passed by the Legislature in mid-January. Officials say the violations occurred later that month and again in February in the Chautauqua County town of Hanover, 30 miles southwest of Buffalo.

    Prosecutors say the sales involved two semi-automatic rifles and more than 300 rounds of ammunition.


    Well, was this legal before Gov. Cuomo instituted the NY SAFE Act or not........?

    Certain aspects were to go into effect on, IIRC, April 15.

    But if arrests have been made then the semi-auto rifle ban must have gone into effect back in January??

    The rifles could no longer be sold in state as of Jan 15th. The "buyer" also told the seller he was a convicted felon and couldn't buy one through legal channels. As they say...the stupid shall be punished.

    Sounds like a set up to me. The buyer told the guy he couldn't legally buy weapons, so he sold them to him anyway?

    That is stupid, but it still sounds like a setup. What buyer would tell you that? Someone who wants a gun but cannot buy one legally is going to lie to you, the joe-blow on the street gun source.

    What this guy allegedly did would likely land him in hot water in most jurisdictions. Three felony charges, with one misdemeanor relating to the SAFE Act:

    Well, that pretty much answers that.

    Sting or not, you just don't go doing things like this if you know full well it's going to be taken for what it is.

    That being said ...

    It's sad that we're at the point in many states where mere purchase/sale of lawful items is itself taken to be the equivalent of a threat, despite nobody having been threatened or harmed. These new laws in NY simply expand that to vastly more citizens, criminalizing such transactions. Which makes a person wonder: if such statutes aren't for crime reduction, then what are they actually for? Citizen control, perchance? Elimination of guns in the long run, the hard way?

    Likely the defendant was on the radar long before the new law. Selling guns to known felons
    is not smart --- end of story.

    Sounds like the new law just added a misdemeanor count to a couple of other felonies. The seller
    cooked his own goose, then poured duck sauce on top.
