    Dayton, OH: 17 yr old pulls gun, gets shot by CCW homeowner

    Police: Teen pulled gun before being shot | www.whiotv.com

    When the video ran on the news a few minutes ago, they said the homeowner had a CCW and was not charged.

    This is the gotcha for a lot of ccw holders. Here in Florida we have the famous stand your ground law, castle doctrine and protection against civil law suits if you are found innocent by reason of lawful self defense. Sounds real good with all these protections BUT the gotcha is that prosecutors will often withhold charging someone in case evidence shows up in the future or they are not 100% certain and want to keep their options open. After all, murder charges can be brought at any time in the future unless you are found innocent. So we have people who are not charged but also not legally found innocent so they CAN be sued in civil court and they are. Most times it is cheaper to settle than pay the legal fees involved. And they often have to hire an attorney to get the State to make a ruling that they are innocent rather than have no disposition to the charges of murder other than no charges pressed at this time. Messes up your life.

    ...don't think it was the homeowner...several sources state "man working at a home" and "the man's boss"...sounds like workers taking good care of customer's property...

    Good post. From what I've read over the last couple of months, it sounds like too many people think they can shoot someone, then say "I felt threatened" and everything is justified without consequence. I'll have to look into the "make a ruling that they are innocent" issue. That would always be the best way to go, but also might be a good idea to have a lawyer in mind before anything ever happens. I know I've said it a hundred times, but I do like the fact that AZ has passed a law that a person injured while committing a felony can't sue.

    From what I've read it was a man working at a home that wasn't his.. two "kids" come up asking to use a phone and then for a cigarette.. one of them pulls a gun to rob said worker... boss sees this and saves his employee by shooting one of the "kids".
