    Baytown police say a man in his 40s ran into the food mart, wearing a mask, brandishing a handgun and demanding money.

    "The clerk, in fear for his life, pulled a weapon of his own, pointed it at the suspect and demanded him to drop his weapon. The suspect failed to do so and the clerk shot at least one time," Baytown Police Department Lt. Eric Freed said.

    Sounds to me like the store clerk was lucky the robber wasn't prepared to fire.

    Mistake #1, IMO: allowing any time to pass while having a robber's handgun in your face. Such a time is not the time for delay. Erase the threat, immediately, else it could be the last thing you ever do.

    Though, the cashier survived it. Apparently there was enough time for such a delay ... this time around. No telling how close the robber's gun was to him, whether it was pointed, merely left in the waistband or what.

    Kudos to the guy for being capable of withstanding and surviving the robbery. Well done.

    ...we aren't required to give a warning to an armed robber...whether his weapon's in his hand, belt, or pocket...once he announces a robbery and threatens us...it's our move...no discussion required...

    Early in the article it states the clerk was female, then it states male. Anyway whomever it was did a fine job, all turned out good. Except for the bg. Give that lady/man a ceegar!

    I noticed that too. In any case the clerk is lucky to be alive. Don't give a scumbag time to shoot. As Tuco said, "when you have to shoot, shoot don't talk".

    I can't second guess unless I know additional facts. What was the posture of the robber when the clerk pulled the gun? What did the robber say, if anything? We don't know.

    Clerk lived, robber is in the hospital gut shot, and he's the only one injured. Sound like success to me.
