The article said the home owner fired to "scare" the intruder away. That could get a person charged with negligent discharge. What he should have done in my opinion was fire for center mass if he felt the threat was ongoing.
On a side note, I ain't QUITE hit 60 yet (be there in a few months) and 9:30 PM sounds like a perfectly good time to be asleep to me!

The intruder started to flee, then turned back toward the home owner, that's when he fired so the report says. If they find the intruder with a bullet entry from behind the home owner could be in trouble. Of course in the dark, who can tell the position of someone.

Shooting to 'scare' the dirtbag away doesn't necessarily mean he wasn't aiming at him...I'm sure the shot DID scare the dirtbag.
We just have to be a bit more careful about what we say when giving an incident account.
I hope that they find this criminal in an emergency room...or a coroner's workspace.

If you pull the trigger, be aiming at the threat. We don't fire "warning shots", those can injured people that are not involved in the break-in.

This is why FL needs better gun control. Those warning shots continue down range, and could harm others. Practice gun control; make sure every round comes to rest in a soft target.
