Deputies: 'intruder' shot in Durham home invasion

DURHAM, N.C. - The Durham Sheriff's Office is investigating a homicide after a man was killed during a home invasion.

Deputies are on the scene at a home on Stoney Creek Circle where investigators say one man is dead. Authorities are still looking for the suspect.

Paul Sherwin with the Durham County Sheriff's Office says investigators believe the person who was shot and killed was an intruder. Authorities say it appears the victim broke in through the back door and struggled with one of the occupants at the home before he was shot in the neck.

Man shot trying to break into east Durham home

Durham, N.C. — A man trying to break into a home in the 300 block of Stoney Creek Circle early Friday was shot and killed by someone inside the home, the Durham County Sheriff's Office said.

Investigators said they believe the intruder had a relationship with someone at the house. Four people were home at the time of the shooting, and investigators said there was a struggle prior to the shooting.

Authorities were trying to locate Carlos Hernandez, who they believe fired the fatal shot and then left the home. He was described as Hispanic and in his early to mid-40s and might be driving a small red sedan.

Deputy Paul Sherwin, a spokesman for the sheriff's office, said investigators aren't calling Hernandez a suspect because they aren't sure whether a crime occurred. The shooting might have been justifiable self-defense, he said.

Maybe the shooter was a felon, and wasn't supposed to have a gun.
