    My Comments: Is this not technically a 'Home Invasion'?

    HOUSTON (KTRK) -- Authorities say a homeowner fought back after three people burst into his southeast Harris County home, and now one person is dead in that burglary gone wrong.

    ....."At this point here, he said there are three strangers, forced entry into his house and robbed him at gunpoint," said Sgt. Ben Beall with the Harris County Sheriff's Office.

    The 23-year-old homeowner fought back. Investigators say as the two men and a woman left his home, he grabbed his gun and shot at the suspected female burglar through the driver's side of the Nissan car she had driven there, killing her.

    "I think every man has a right to protect his home," a nearby neighbor said.

    .....And as neighbors watched from outside, some were seriously considering arming themselves, too.

    Shooting someone as they're fleeing? Personally I wouldn't risk it for some money. Sounds like the road to pain in court. But then, I carry at home all the time, so it probably wouldn't have gone down that way.

    Jeebus, he shot and killed one while they were driving away? He's lucky he's not in a holding cell with the survivors.

    Now wouldn't that be some "stuff"..

    If somebody's fleeing from my home (without a loved one, that is), I'm just gonna let them go and let the cavalry try to round them up.

    How was he to know the girl he shot, the driver, wasn't coerced into driving them, or unaware? It's not likely but it's possible. Lucky he's not in jail.

    Perhaps the BGs were getting more firepower out of that car for all we or the homeowner might have known. I sure don't fault the homeowner for his response.

    An un-authorized entry is a burglary, whether the domicile is occupied or not. If it's occupied, it's commonly called an invasion, but it's still a burglary. Whether a state's statutes differentiates between the two is up to the state.

    I'm not faulting him, certainly he's not the 'bad guy' here, it just strikes me as risky from a liability standpoint.

    "Burglary gone wrong"? How does a burglary go right?

    Home owner is o.k., one BG dead. What's wrong with that?
